CITY POP 2NIGHT TERMS AND CONDITIONS

The following Terms and Conditions (“T&C“) represent the contract between Guests and City Pop AG (“City Pop 2NIGHT“). Guests agree to read and to electronically confirm the T&C, and by having done that all Guests declare that they have understood and agree to all T&C provisions contained herein, prior to concluding any contract.

 

  1. City Pop 2NIGHT
  • City Pop AG, domiciled at Bernerstrasse Süd 169 CH-8048 Zurich, Switzerland, by virtue of its agreement with the building owner, is the operator of the building for which these T&C apply.
  • City Pop 2NIGHT provides fully furnished (see section 6) apartments or rooms (“Pops“) for stays starting from one night with fixed comforts included in the booking price plus additional comforts available for an extra fee.
  • City Pop 2NIGHT reserves the right to check the guest’s creditworthiness within the usual scope. By making a booking request, the guest gives City Pop 2NIGHT the consent to do so.
  • Guests can contact City Pop 2NIGHT through WhatsApp, email ([email protected]) or phone.
  • Members of the City Pop 2NIGHT Team have the right to enter the Pop within the course of their duties. In case justifiable reasons (e.g. cleaning, adjust the temperatures and change the setting of the heating etc.), the Pop may be entered without the Guest’s presence. City Pop 2NIGHT will inform in advance the Main Guest through email or SMS or WhatsApp message when a City Pop 2NIGHT Team will enter the Pop. In case of emergency the Pop might be accessed any time.

 

  1. Guests
  • When referring to Guests in the T&C, provisions apply to both the Main Guest and the Additional Guest(s). Additional Guests are only those registered by the Main Guest within the booking process, during check-in.
  • The 2NIGHT Pop booked may only be used by guests who have been registered and accepted in advance by City Pop.
  • Guests are temporary users of 2NIGHT Pop. The booking guest is responsible and liable for any Additional Guest. Each adult and each child counts as one person.
  • When booking, the guest must specify the number of people who will be staying in the accommodation – including any persons who do not stay overnight but are present in the Pop. The maximum number of people specified at the time of booking may not be exceeded for contractual, structural and legal reasons, and in particular for police reasons.
  • Children count fully toward maximum occupancy. No extra beds, cots, or child‑specific equipment are provided unless explicitly listed for that Pop. Occupancy limits are strictly enforced for safety and legal compliance.
  • The Main Guest is obliged to fully and truthfully complete the booking request providing the mandatory data for every guest, such as name and surname, personal contacts (email address and phone number), residence (country, city and home address), nationality and date of birth. Also, the uploading of a valid document for each guest (passport or identity card) together with the indication of both the expiration date and the issuing country is required. If not done properly, no check-in will be possible, neither for the Main Guest, nor for any Additional Guest/s. For identity documents that do not use the Latin alphabet, an officially verified translation must be uploaded.
  • The email address provided by the guest at the time of booking must be used for further communication between the guest and City Pop 2NIGHT.
  • False information provided during or after the booking, particularly a breach of the guest’s reporting obligations, shall be considered a serious breach of contract and shall entitle City Pop 2NIGHT to terminate the contract immediately without the guest being entitled to a refund. We reserve the right to claim any further damages.
  • Bookings by third parties for a guest are possible, provided that the third party is related to the guest or is responsible for them (subject to valid legal or contractual representation). Other bookings by private third parties for other guests are not permitted.
  • Bookings by commercial agents for their own customers are permitted if these agents have concluded in advance a corresponding cooperation agreement with City Pop 2NIGHT.

 

  1. Guests’ reporting obligation
  • If the personal status of the guests or other information provided at the time of booking (personal data, addresses, telephone numbers, etc.) changes during the stay, the guest must notify City Pop 2NIGHT immediately and without being asked.
  • The guest shall be liable for any defects in the inventory, in permanently installed fixtures and in the buildings that are not reported immediately upon moving in, which are present at the time of moving out and which were not already known to City Pop 2NIGHT.

 

  1. Fixed contract term
  • The booking of a 2NIGHT Pop is made for the fixed contract term as shown in the booking confirmation.
  • Once the reservation has been confirmed, the customer is obliged to pay for the stay in accordance with the conditions stated. Cancellation fees may apply depending on the booking rate and policy.
  • Special offers that have been booked cannot be cancelled. There will be no refunds for special offers that have already been booked and paid for.
  • If a guest decides to extend his stay, a new booking must be made.
  • Any extension of the length of stay will be reported to the authorities as required by law.
  • An extension of the stay does not entitle the guest to remain in the 2NIGHT Pop previously used. During the booking process, the guests will be informed about which 2NIGHT Pop can be booked.

 

  1. Permitted purpose of use
  • The booking is valid for a 2NIGHT Pop for the fixed number of registered people with fixed amenities included in the booking confirmation.
  • The booking entitles the guests to use the booked accommodation and the included amenities for the registered number of people.
  • There will be no refund for amenities booked but not used.
  • The Pop must be used exclusively for short and medium-term accommodation purposes. Any other purposes of use are not permitted.
  • In particular the Pop must not be used for commercial purposes and the address of City Pop 2NIGHT may not be used as a business address.
  • All commercial activities that lead to increased traffic of people or goods (or otherwise cause disruptive emissions [e.g. noise, smells, light, vibrations etc.], including but not limited to paid consulting services, paid lessons, paid training and courses, wellness services (massages, sexual services, etc.) and a permanently installed business operation with passenger and/or freight traffic, are not permitted in the 2NIGHT Pop and in the generally accessible areas.
  • The general facilities and 2NIGHT Pop can be viewed on the website as examples. City Pop does not guarantee the permanent availability of general facilities (subject to maintenance, repairs, changes to facilities, etc.) or the availability of 2NIGHT Pop shown as examples on the website at any time.

 

  1. Comforts included in the price

6.1. Cleaning

  • Standard cleaning is included in the booking price, and its frequency is stated in the booking process and on the website. If the guest wishes to know more about the cleaning policies, he may contact City Pop 2NIGHT by mail.
  • 6.1.2   The cleaning team does not tidy up the 2NIGHT Pop and does not clean areas occupied by guests’ belongings.
  • 6.1.3   Standard cleaning frequency is displayed during booking. Unless otherwise stated, housekeeping does not include dishwashing or tidying of personal belongings.

 

6.2. Appliances, equipment and facilities

  • Depending on the location and the type of accommodation booked, Pops have Wi-Fi, Smart TV, furniture, including customary mattress and bedding (pillows and blankets), bathroom, kitchenette or kitchen with customary amenities (cutlery, kitchen utensils) and home textiles (bath and hand towels, kitchen towels, bed linen). Some Pops do not have kitchenette with customary amenities and the Pop assigned will be coherent in terms of amenities with the one booked.
  • City Pop 2NIGHT does not offer single beds in any Pop. All accommodations are equipped exclusively with the standard bed configuration indicated in the room description at the time of booking. It is not possible to request single beds, additional individual beds, or modifications to the existing bed setup. Guests acknowledge that the sleeping configuration cannot be altered and that no alternative bed types are available.
  • The household textiles are property of City Pop 2NIGHT or its partners. The household textiles must be returned at the check-out in the same undamaged state how they were provided at the check-in.
  • The in-house, common facilities are intended for usage by Guest/s, exclusively. Third parties from outside the building, or friends not using booked 2NIGHT Pop or any associates of the Guest/s are not entitled to use.
  • Where facilities are available for all Guests, a “first come, first served” principle applies. The right to use such common facilities is not exclusive and they can only be used subject to availability.
  • The voluntary non-usage of included comforts does not entitle the Guest/s to a price reduction.

 

6.3. Internet use

  • City Pop 2NIGHT’s free Wi-Fi includes Internet access and unlimited data usage.
  • City Pop provides a standard provider service. Reliable data on data transmission speed is not available, and guarantees are not possible, since this depends on factors over which City Pop 2NIGHT has no influence, as the general network stability and network utilization within and outside of the building. Therefore, City Pop 2NIGHT shall not be liable for any unavailability, interruptions, or reduced performance of the internet connection.
  • The use of the Wi-Fi network (“Network”) provided at the City Pop 2NIGHT site is governed by the Wi-Fi Terms and Conditions described at point 8 in detail. By connecting and using the Network, Guest/s agree to comply with these terms.

 

6.4. Common areas

  • Depending on the location, in-house common areas and other locations, Co-Liv, which are available free of charge at the respective City Pop 2NIGHT site, are not for individual Guests’ exclusive use.
  • Where available, Co-Liv spaces are ruled by special conditions (binding house rules and/or leaflet) stated in the “City Pop Housing Rules”.
  • The in-house common areas are to be used exclusively for ordinary leisure activities. In particular, no political or religious events can be organized or any other activities that are incompatible with the permitted purpose of use.

 

6.5. Breakfast

  • Depending on the location, B&B rates may also be available. In case guests select this kind of option, breakfast will be included in the price. In this case, the voluntary non consumption of breakfast does not allow a price reduction.

 

6.6. Luggage storage

  • Depending on the City Pop 2NIGHT location, also a luggage storage may be available.
  • Luggage storage is offered solely for temporary use in relation to a confirmed stay and may not be used as an ongoing or permanent storage solution. Any items left beyond the agreed stay period may be removed and may incur additional charges.

 

  1. Additional comforts/payable additional services
  • The range of payable additional services is different depending on the location of the City Pop 2NIGHT. To include an additional service to the stay, the Main Guest uses the specific Guest App section. References in these Terms & Conditions to the “App” do not refer to the City Pop mobile application available in the Apple App Store or Google Play Store. For City Pop 2NIGHT stays, “Guest App” means the secure online webpage made available to Guests after successful completion of the digital check‑in process. This online portal provides access to essential stay information, additional services, instructions, and communication tools. Access to this webpage is personal, browser‑based, and linked to the Guest’s reservation; it does not require the download of any mobile application. Payment must be made immediately by credit card, except for the services for which payment must be completed through the third-party provider’s app.

7.1. Self-service laundry

  • Depending on the City Pop 2NIGHT location, self-service washing machines and tumble dryer may be available in the building. These facilities can be used by all Guests. Terms of use, prices, payment method and instructions for use are available on the third-party provider’s app or website.
  • Depending on the City Pop 2NIGHT location, the laundry service can be booked via the provider’s app or by scanning a QR code located in the laundry room.

 

7.2. Ironing Station

  • An ironing station is available for all Guests and can be used during the stay. Equipment must be handled with care and returned to its original condition after use. In case of malfunction or damage, please report it immediately.

 

7.3. Final Cleaning

  • The final cleaning is mandatory for all stays above 28 nights, and the costs will be shown to the Main Guest at the time of the booking. These costs will be displayed separately. At the time of check-out, if the room requires additional cleaning time compared to normal standards due to its condition, City Pop 2NIGHT reserves the right to apply an extra charge to cover the associated cleaning costs, which will be deducted from the Main Guest’s deposit, without express consent requirement by the Main Guest.

 

7.4. Parking Lots

  • Bookable Parking Lots for vehicles are available in certain City Pop locations. The Parking Lots are not monitored. City Pop will neither be liable for theft nor for burglary.
  • The booking of a Parking Lot without an accommodation being booked at the same time is usually not possible.
  • It is not allowed to stock personal items on a Parking Lot. Cars or motorcycles/bicycles are the only vehicles permitted to park. Payable charging facilities might be available.
  • Subject to availability, Parking Lots can be booked as additional payable comfort during the booking request and/or during your stay either for the entire or for the remaining duration of the stay, or else for a shorter period.

 

  1. Internet connection
  • The use of the Wi-Fi network (“Network”) provided at City Pop Sites is regulated by the following Wi-Fi Terms and Conditions as mentioned in clause 6.3.3. By connecting to and using the Network, Guest/s agree to comply with these terms and conditions. Failure to do so may result in suspension of access, termination of services, or legal action where applicable.

8.1. Fair Usage Policy

  • The Wi-Fi service is provided as a shared resource for all Guests to use fairly and responsibly.
  • Bandwidth is not unlimited and excessive usage that negatively impacts other users (e.g. prolonged streaming, large downloads, or hosting servers) is forbidden.
  • The Network is intended for personal use only. It must not be used for commercial activities, reselling bandwidth, or operating a business.
  • Streaming, gaming, video calls, and downloading are permitted within reasonable limits that do not disrupt the overall Network performance.
  • The building management or network administrator reserves the right to limit speeds, block certain applications, or implement traffic management measures if usage patterns negatively impact the service for others.

 

8.2. Prohibited Activities

Guest/s must not engage in any activities that are illegal, harmful, or disruptive to the Network. Prohibited actions include, but are not limited to:

8.2.1. Malicious and Illegal Use

  • Hacking, unauthorized access, or penetration testing of any system or network.
  • Distribution of malware, viruses, or phishing attempts.
  • Engaging in cybercrime activities, such as fraud, identity theft, or unauthorized data collection.
  • Any use that violates local, national, or international laws, including copyright infringement, hacking, or illegal downloading.

8.2.2. Network Abuse

  • Using the Network to send spam, unsolicited communications, or bulk messages.
  • Running servers, torrents, or high-bandwidth applications that degrade network performance.
  • Attempting to bypass security measures or gain unauthorized access to other devices.

8.2.3. Inappropriate or Offensive Content

  • Hosting, sharing, or distributing offensive, defamatory, obscene, or illegal content.
  • Engaging in activities that promote violence, discrimination, or hate speech.

 

8.3. Monitoring and Enforcement

  • The building management or network administrator reserves the right to monitor traffic patterns to ensure compliance with this policy.
  • If a Guest is found to be in violation of this policy, actions may include: warning or temporary suspension of access; permanent disconnection from the Network; legal action, including reporting to authorities for criminal activity.
  • The Network is not guaranteed to be secure, and users are responsible for their own cybersecurity measures, such as using firewalls, VPNs, and strong passwords.

 

8.4. Limitation of Liability

  • The Wi-Fi service is provided on an “as is” and “as available” basis, with no guarantees of uptime, speed, or uninterrupted service.
  • The building management is not responsible for any data loss, hacking incidents, or security breaches that occur on the Network.
  • Guest/s assume all risks associated with connecting personal devices to the Network.
  • Changes to Terms: these terms may be updated periodically to reflect changes in policies, security measures, or legal requirements. Continued use of the Wi-Fi Network constitutes acceptance of the latest terms applicable. For inquiries or to report network abuse, contact City Pop.

 

8.5. City Pop Internet Connection Acceptable Use Policy

Guest/s must comply with all applicable laws and regulations when using the shared internet connection. The following activities are strictly prohibited:

  • Unauthorized access to or use of data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without express authorization.
  • Sharing the internet connection with individuals outside of the group of authorized users.

To ensure equitable access to the shared internet connection, this policy is in place:

  • Each user is allocated a specific speed capacity that can be up to 100 Mbps / device.
  • Activities that consume excessive bandwidth, such as large file downloads, and peer-to-peer file sharing, should be limited to off-peak hours to avoid congestion and ensure fair usage for all users.
  • The provider reserves the right to monitor data usage and take necessary actions to prevent abuse of the shared internet connection, including throttling bandwidth, terminating access for users who repeatedly engage in prohibited activities.

 

8.6. Maintenance Policy

To ensure the optimal performance and reliability of the shared internet connection, City Pop will adhere to the following maintenance policy and thus 3 types of maintenance windows might occur during your stay.

  • Scheduled Maintenance: Regular maintenance will be conducted during off-peak hours to minimize disruption. You will be notified at least 48 hours in advance of any scheduled maintenance that may impact service availability.
  • Emergency Maintenance: In the event of unexpected issues or urgent security threats, City Pop may perform emergency maintenance without prior notice. Users will be informed as soon as possible about the nature of the emergency and the expected duration of the maintenance.
  • Service Interruptions: During maintenance periods, users may experience temporary interruptions or reduced performance. City Pop will make reasonable efforts to complete maintenance tasks promptly and restore full service quickly.
  • User Support: If users encounter connectivity issues or require assistance during maintenance periods, they should contact City Pop. The provider will offer timely updates and support to address any concerns or problems that arise due to maintenance activities.
  • Infrastructure Upgrades: periodically, the provider may upgrade the network infrastructure to improve service quality and performance. Users will be informed of major upgrades and any potential impacts on their internet connection in advance.

By agreeing to these terms and conditions, users acknowledge and accept that occasional maintenance is necessary for the upkeep and enhancement of the shared internet connection and agree to comply with the policies outlined above.

 

  1. Booking process
  • Guests wishing to stay in a City Pop 2NIGHT Pop can check the availability of the accommodations and follow the booking process directly through City Pop 2NIGHT official website (citypop.com) or through third party booking platforms.
  • Regardless of the channel used to make the booking, the Guest remains fully subject to the City Pop 2NIGHT Terms & Conditions.
  • Regardless of the channel used, Guests must provide the necessary information and evidence to complete the booking.
  • The option to book additional, chargeable comforts depends on the location of the City Pop 2NIGHT property. Guests will be informed and will be allowed to book any additional comforts available at an extra cost during the booking process or subsequently in the Guest App (available only after completion of the check-in process).
  • After completing the booking application, the Main Guest must fully complete the mandatory identification procedure during the check-in process. In case the guest fails in completing the procedure this constitutes a serious material breach of the preconditions to conclude a contract, and the booking process can be terminated with immediate effect without any compensation.
  • Whenever the identification process is not completed for all Guests, no access to the 2NIGHT Pop will be granted to the Guest/s.
  • The application will be declined if the Main Guest is below 18 years old or if accompanying minors are not relatives of the Main Guest. The granting of exemptions requires the consent of the legal guardian(s) of the minor.
  • Application will be declined if Guest/s have non-valid or expired legal documents (ID, Passport, Visa etc.).
  • Application will be declined if Guest/s have compromised or false legal documents, namely whether a document is publicly available or known as compromised or it has been reported as used in a suspicious way.
  • Application will be reviewed if some parameters do not fully satisfy the ID verification internal procedure.
  • Payment must be made according to the payment policy and method stated during the booking process. Cash payments are not accepted. Receipt of payment is a prerequisite for the legal validity of the booking. Regardless of any confirmation, City Pop 2NIGHT is not bound by the booking if the payment is not received by City Pop 2NIGHT as agreed. Guest remains fully liable since the booking confirmation has taken place.
  • Cancellation and amendment conditions are rate‑dependent and are displayed during the booking journey and on the confirmation. Non‑refundable rates cannot be cancelled, amended, or refunded. Flexible rates may be cancelled or amended free of charge until the deadline shown at booking; after the deadline, the charges shown for the selected rate apply. A no‑show is treated as a late cancellation under the booked rate conditions. Refunds (when applicable) are processed to the original payment method; processing times depend on the payment provider.
  • Reservations made via Online Travel Agencies follow the no‑show definitions and financial rules set by the respective platform. City Pop 2NIGHT applies the same no‑show charges stated in the OTA rate selected by the Guest.
  • Corporate and relocation bookings may follow negotiated terms regarding cancellation, invoicing, check‑in handling, and communication procedures. These agreed terms prevail over the standard T&C only if expressly stated in the written corporate agreement.
  • The access code to enter the Pop will be given only after the check-in procedure. Any additional statutory charges or fees or additionally ordered services will be shown separately at the time of booking.
  • The information provided by the Guest/s with the application will be processed and stored in accordance with the legal provisions and will be treated according to City Pop Privacy Policy (citypop.com/privacy-policy) in accordance with the applicable legal regulations at the relevant Site. Any notification to authorities etc. is made in accordance with the statutory provisions.
  • The information contained in the booking request will be used by City Pop to fulfill its reporting obligations to the police, municipal authorities and other competent organizations (e.g. tourist tax). These reports do not replace any additional registration requirements with the municipal authorities that will be up to the guest (if necessary).
  • The Guest is hereby informed and aware that the pictures of the Pop on the Website and in Third Party Booking platforms refer to a real Pop at the Site, but these pictures may not correspond to the exact Pop booked. Not only the layout but also some decorative items or furniture arrangement may differ in the de facto booked and assigned Pop.
  • City Pop reserves the right to assign the guest a different 2NIGHT Pop before or after check-in if the previously assigned Pop is damaged or inaccessible for other reasons. If the newly assigned Accommodation is cheaper than the previously assigned one, City Pop will refund the guest the difference in price. If the newly assigned 2NIGHT Pop is more expensive than the previously assigned one, City Pop 2NIGHT will waive any additional costs.
  • In the event that the reserved room is unavailable at the time of check-in for any reason, City Pop 2NIGHT will make its best effort to arrange alternative accommodation of comparable standard at no additional cost to the guest. Should the guest refuse the proposed alternative or should City Pop 2NIGHT not be able to provide an alternative, City Pop 2NIGHT’s liability shall be limited to a refund of the unused nights. The guest shall not be entitled to any further compensation or damages.
  • Depending on the City Pop location, City Tax or other mandatory tourism taxes may apply in accordance with binding local regulations. Guests are required to prepay these taxes (such as City Tax per night) during the booking process. City Pop collects these taxes on behalf of the local authority and subsequently transfers them accordingly. Guests are responsible for informing themselves about publicly available online resources provided by responsible authorities or public bodies, where they can find all necessary information regarding potential exemptions and other relevant details about local tourism laws. The same rules apply to all additional Guests, starting from their notified and registered day of arrival.
  • City Pop reserves the right to decline a booking even after the Guest has received an automatic booking confirmation. The booking will be declined in due course, and this will entail a full refund of the amount paid.
  • Failure to comply with mandatory reporting obligations and non-fulfilment of any legally binding requirements by the Guest constitute material breaches of the contract, which entitles City Pop to terminate the contract, immediately.

 

  1. Check-in and check-out

10.1. Check-in

  • The City Pop 2NIGHT location is operated without on-site staff. The Guest will receive a notification to the email address provided so that they can complete the self-service check-in. The latest check-in time is specified in the listing available on the Website or in the external platform. If the third-party platform does not display the check-in time, it is guest responsibility to check the check-in times on the official website (Citypop.com). The booked 2NIGHT Pop can be accessed from 3 p.m. Access is keyless. An entry code will be provided on the day of check-in, only if the online check-in has been completed successfully.
  • During self-service check-in, it is mandatory to enter the data of every guest, including personal data, in order to verify their identity, contact details and other legally required information. The scope of the required data disclosure and data collection depends on the locally applicable legal provisions. Data are collected in accordance with City Pop Privacy Policy (citypop.com/privacy-policy/).
  • After successful completion of the self-service check-in, City Pop 2NIGHT will provide the Guest with essential information about the location (address, including street, number of the City Pop 2NIGHT property, postcode of the city and number of the 2NIGHT Pop assigned to the guest). Completion of the digital pre‑check‑in is mandatory. This includes ID verification, personal data submission and a valid payment card. The access PIN is generated and sent automatically on the day of arrival only after successful completion of all required steps. Without the completed pre‑check‑in, no access PIN can be issued, and the Guest cannot enter the Pop.

 

10.2. Check-out

  • The Guest must leave the Pop on the last day of the agreed contract period. In the App and on the Website the check-out time is indicated.
  • For the check-out, the Guest receives procedure instructions via email and, where applicable, via SMS or WhatsApp message. The Guest is obliged to inform City Pop 2NIGHT of any damage or destruction of the Inventory entrusted, before departing.
  • Damage to or destruction of the Inventory, which exceeds normal wear and tear, and/or damage caused by improper use shall be charged to the Guest. The amount of compensation payable depends on the time value of the damaged or destroyed object(s), summing up to the amount of the repair costs plus the damage management costs of City Pop 2NIGHT.
  • Guest/s must vacate the Pop completely and must take all their belongings.
  • If Guest/s rented a storage box or a parking lot, they are responsible for emptying the storage box and moving the vehicle. The disposal costs for items left in the Pop, in the storage box or in the parking spot after the check-out time has elapsed will be charged to the Main Guest.
  • After the Guest has vacated the Pop upon check-out, City Pop will carry out a control of the Pop and of the Inventory.

 

10.3. Early Check-In and Late Check-out

Early check‑in and late check‑out are subject to availability and may incur a fee. Unapproved late check‑out beyond the published time may lead to: (i) a late departure fee (CHF 70.00), and/or (ii) the charge of an additional night if the Pop cannot be made available for the next Guest, and (iii) reimbursement of demonstrable operational costs (e.g., rescheduled cleaning). Access codes may deactivate automatically at or after check‑out time.

 

  1. Booking price/payment & deposit amount
  • Until the booking is confirmed, the price is not guaranteed and may be updated regularly. Once the booking is made, the price for that period will remain unchanged.
  • The booking must be paid in advance, in accordance with the selected Payment Policy and payment plan. Please note that for certain instalment options, the payment plan differs and the full amount is not due immediately. The instalment schedule chosen at the time of booking (as per the applicable Payment Policy) and its related terms and conditions will apply.
  • The total price and the applicable payment schedule are displayed during the booking process and in the booking confirmation. If the guest wishes to know more about the payment schedule, he may contact City Pop 2NIGHT by mail.
  • The accommodation will not be made available if the total payment – including the deposit amount – has not been completed in accordance with the booking terms.
  • Additional services are subject to the rates applicable at the relevant City Pop 2NIGHT property and must be paid in advance at the time of booking.
  • Transactions made by credit card between the Guest and City Pop 2NIGHT are processed by an external operator, to whom the guest’s recorded credit card details are communicated.
  • City Pop 2NIGHT may charge an amount (the “Security Deposit Hold“) on a valid payment card provided by the Main Guest in the amount displayed during the booking and/or online check‑in flows. This Hold is intended to secure potential costs arising from damage, excessive cleaning, policy breaches, unpaid amounts or additional services, or lost keys/badges.
  • Following the Guest’s check-out, City Pop 2NIGHT will inspect the Pop and its Inventory. The Security Deposit Hold will be released in full provided no damage, missing items, excessive cleaning, policy breaches, or outstanding charges are identified. In the event of any such issues, City Pop 2NIGHT reserves the right to retain all or part of the Security Deposit Hold to cover the related costs. The release of any remaining amount will be processed after the inspection. The timing of the actual release of funds is subject to the card issuer and is outside City Pop 2NIGHT’s control.

 

  1. Payment arrears
  • City Pop is entitled to terminate this contract (and take back possession of the 2NIGHT Pop) if the Guests fail to fulfil their obligations under this contract (additionally purchased amenities), including obligations relating to additional services purchased, provided that the guest has not remedied the breach shortly after receiving the notice of default from City Pop 2NIGHT.
  • Upon termination of the contract or upon expiration of the booked and paid term, City Pop 2NIGHT is entitled to enter the accommodation for the purpose of clearing it, to pack up the guest’s belongings and move them to another location, to draw up an inventory and a list of damages, including disposal costs (labour plus disposal fee) for waste and depreciation, to lock up 2NIGHT Pop, to block further access and, after restoration, to make it available for booking by other Guests at a later date.
  • City Pop 2NIGHT may, at its own discretion, contact the competent authorities in case of required circumstances.
  • The guest is obliged to bear the additional costs incurred by City Pop 2NIGHT as a result of the unscheduled clearance. In particular, the guest is obliged to pay for the vacancy period during the remaining booking period (booking price for the contractually agreed period until the same 2NIGHT pop is booked by another guest, etc.).
  • All additional costs incurred by the involvement of an official, the preparation of the inventory, additional disposal costs and the storage of the guest’s personal belongings (only items of value) or otherwise also be charged to the guest and shall be paid by them.
  • The guest’s inventoried personal belongings of value (objects or documents that appear to be worthy of preservation according to local understanding, according to the autonomous, careful and comprehensible discretion of City Pop 2NIGHT) will be stored by the property for one month. During this period guests can collect their things at the property. City Pop 2NIGHT is not responsible for the dispatching of the belongings. It is fully responsibility of the guest for the pick-up arrangement.
  • If the guest does not collect the stored items after one month, City Pop 2NIGHT is entitled to dispose of or recycle the items at its own discretion.
  • The guest’s certificates and other identification documents shall be kept for 10 years at the guest’s expense. After this period, City Pop is entitled, but not obliged, to dispose of the guest’s certificates and other identification documents.

 

  1. Guests’ liability
  • Guest/s are liable for damages caused by careless, improper or contractually adverse use of the Pop, the inventory, the equipment or the generally available facilities or installations. Liability applies both to the damage to property (repair costs for correcting the defect) and to the administrative costs incurred (organisation and monitoring of the defect’s rectification), the latter at cost price.
  • Guest/s are liable for all damage to the building and its fixed installations and for all damage to property of third parties, that occur within the building and are caused by Guest/s.
  • City Pop 2NIGHT may, at its own discretion and without legal obligation, propose a lump sum payment (e.g. the retail price or goodwill price or similar) to settle the claim and expedite the resolution process.
  • Unauthorized changes of any kind to the inventory, installations and facilities by the guests in the 2NIGHT Pop or in the common areas are prohibited. The guest shall pay the costs incurred for the professional repair of unauthorized alterations and for replacement or restoration to proper conditions within 5 days of the invoice date (due date).
  • In the event of a false fire alarm triggered due to Guest behaviour, including but not limited to smoking or misuse of fire safety equipment, a fee of CHF 2,000.00 will be charged (subject to further claims for damages).

 

  1. City Pop liability
  • City Pop 2NIGHT is liable, within the scope of its own services, exclusively for its own, grossly negligent behaviour. Furthermore, City Pop 2NIGHT is not liable in cases of force majeure or for any kind of damage incurred by the Guests.
  • City Pop 2NIGHT is not liable for any problems with access to the building, in the context of the local, possibly even extreme weather conditions (snow, ice, hail, heavy rain, etc.), since the safe use at any time cannot be guaranteed, and also the individual, weather-adequate equipment of Guest/s and the degree of familiarisation of Guest/s with the local climate can vary greatly.
  • City Pop 2NIGHT ensures its own liability risks to the extent required by local laws.
  • If, despite reasonable efforts, a booked service is exceptionally unavailable for a longer period of time, the guest is only entitled to a discount in accordance with City Pop 2NIGHT’s usual practice for the period of non-use. No compensation is owed.
  • City Pop 2NIGHT completely excludes liability for auxiliary persons to the extent permitted by law. City Pop 2NIGHT shall ensure the proper selection, instruction and supervision of auxiliary people within the framework of the legal requirements.
  • City Pop 2NIGHT shall not be liable, regardless of value, for loss, theft or damage to the personal belongings of the guest (items, cash, other means of payment, etc.) unless this loss or theft has been proven to be caused by poor service on part of City Pop 2NIGHT. All Guests are required to keep valuables in locked cupboards, especially if not present in the Pop at the time when services are provided. All Guests are responsible for ensuring that high value items are adequately insured and/or sufficiently protected against access by unauthorised persons.
  • City Pop 2NIGHT declines all responsibility for any damaged items owned by City Pop 2NIGHT on the City Pop 2NIGHT Site or of your own property, in your Pop, within the building or outside the building (washed and dried clothes in the laundry room, items stocked in the storage box, parked vehicle, etc.).
  • If City Pop 2NIGHT is legally liable, this liability is limited to CHF 1,000.00 per incident.
  • City Pop 2NIGHT shall not be liable for any failure or delay in performing its obligations if caused by events beyond their reasonable control, including but not limited to acts of God, natural disasters, epidemics/pandemics, governmental restrictions, strikes, civil unrest, utility outages not caused by the affected party, or failure of public services. Where performance is affected, obligations are suspended for the duration of the event.
  • Certain services—including but not limited to laundry, digital check‑in, OTA booking platforms, identity verification providers and payment processors—are operated by third parties. City Pop 2NIGHT is not liable for interruptions, errors, or failures caused by such providers.
  • The measures taken to ensure the safety of people and property are in accordance with customary local practices. There is no seamless monitoring of all generally accessible areas.

 

Amenities Warranty Disclaimer

  • All amenities, facilities, furnishings, equipment and services provided by City Pop 2NIGHT, whether located inside the Pop or in common areas, are offered on an “as available” and “as is” basis. City Pop 2NIGHT does not guarantee uninterrupted availability, specific performance, or the suitability of any amenity for a particular purpose.
  • Temporary unavailability of amenities—including but not limited to Wi‑Fi, common areas, lifts, laundry services, heating or cooling systems, lighting, kitchen equipment, or other building installations—may occur due to maintenance, repairs, technical failures, safety measures, or operational needs. Such temporary unavailability does not entitle the Guest to compensation, price reduction, termination of the contract, or any damages, except where mandatory law requires otherwise.
  • Guests use all amenities and common area equipment (including fitness devices, kitchen appliances, laundry equipment, and other shared installations) at their own risk. Guests are responsible for ensuring that they are physically able to use the equipment safely and must follow any displayed instructions, house rules, usage guidelines, and safety notices.
  • City Pop 2NIGHT is not liable for: misuse, improper handling, or unsafe operation of amenities by Guest(s) or third parties; personal injuries arising from voluntary use of amenities unless caused by proven gross negligence of City Pop 2NIGHT; failures or deficiencies caused by third‑party providers, public utility disruptions, or factors outside City Pop 2NIGHT’s control; inaccuracies or deviations between advertised amenities (including photos or examples) and the amenities actually available during the Guest’s stay.
  • Where an amenity is operated or provided by a third‑party supplier, the Guest may also be bound by that provider’s terms and conditions. City Pop 2NIGHT assumes no responsibility for interruptions, malfunctions, or unavailability resulting from third‑party services.

 

Completeness of the booking conditions/deviating agreements

  • The regulations applicable to the booking are set out conclusively in the property description, the information provided in the booking request, the booking confirmation, the General Terms and Conditions and the applicable statutory provisions. No other provisions apply. Furthermore, no verbal agreements exist, and such agreements are not permitted.
  • If the guest wishes to have special conditions and/or deviations from these General Terms and Conditions, these must be specifically and expressly agreed with City Pop 2NIGHT.
  • Any additional agreements with the guest in individual cases must be made in electronic form at a minimum, which must include the express acceptance and confirmation by City Pop 2NIGHT. Acceptance by tacit consent is explicitly excluded.
  • City Pop 2NIGHT is entitled to warn Guests, within the framework of these regulations, agreements and legal provisions, to comply with them and to issue corresponding instructions (right of instruction / house rules / code of conduct, etc.).

 

Updates to the T&C

City Pop reserves the right to change or modify the content of these T&C. Any new version will be available on the City Pop Website and shall take legal effect from the date of such posting. The Guests will be notified of any amendments by email to the address used for the booking. It is the Guest’s responsibility to regularly check their email account (including spam or junk folders) and to inform City Pop of any changes to their email address. Without written objection within 10 days, Guests are deemed to have accepted and agreed to the latest version of the T&C, as binding and applicable.

 

Additional or missing provisions

If, during the booking period, a legally relevant issue has not been regulated or it has not been regulated sufficiently, or if a provision originally or subsequently does not prove to be legally feasible, the filling of the gap will be done primarily in analogy to the provisions already made and the economic intent and purpose, taking into account the economic balance between the Guests and City Pop 2NIGHT. The meaning and spirit of the previous booking and the associated provisions and agreements made shall be preserved as far as possible. The highest guideline is an appropriate, substitute, universally applicable, but also fair in a concrete individual case, solution that is appropriate for the operating concept of City Pop 2NIGHT.

 

Applicable law

  • Guests agree that bookings are purely digitally confirmed and processed. There is no requirement for a written copy and signature on the booking.
  • The law of the country where the City Pop 2NIGHT building operates is the applicable law that will apply to all matters involving all agreed contracts, if not ruled by the provisions of this T&C yet.
  • Exclusive and sole place of jurisdiction are the courts of the city in which the Pop is situated. If proceedings are brought in other jurisdictions, no statement of defence will be made, and all foreign decisions will be deemed null and void. Arbitration tribunals and other alternative litigation proceedings are expressly excluded.
  • Should City Pop 2NIGHT incur costs because of unauthorised claims by Guest/s at other places, at arbitration tribunals or other alternative litigation, Guest/s are obliged to fully pay all costs incurred in connection therewith, regardless of cost-bearing decisions in other, inadmissible proceedings.

 

Code of conduct and right of use

 

The code of conduct for City Pop 2NIGHT users ensures the peaceful coexistence of all guests. It is intended to enable all guests to have a pleasant and respectful stay. Every guest is obliged to comply with it. The main guest is responsible for any misconduct on the part of the other guests. With the booking confirmation, the guest confirms that they have understood the code of conduct. Significant or repeated non-compliance with the code of conduct by the guest and accompanying persons entitles City Pop 2NIGHT to terminate the contract.

 

  1. Appropriate operation of the Pop, installations, furniture and equipment
  • All guests are obliged to use the building, facilities and inventory with care and in the usual manner. Damage or destruction and the replacement costs must be compensated by the responsible guest. Guests should not carry out any independent repairs within the Pop, of installations, of other equipment or of furniture. Guests are obliged to report damages and any repairs required to City Pop 2NIGHT.
  • Structural and furniture changes are strictly prohibited. The furniture must not be altered or damaged. Guests may bring in your own, movable, small furniture items, which may not be permanently mounted or installed in the Pop. The small furniture brought in may not damage the existing equipment or remaining furniture. The permanent installation of satellite dishes or other technical equipment as well as the insertion of further cables is prohibited.
  • Guests are not allowed to remove from the apartment and/or give away any furniture, furnishings or equipment. It is also not permitted to bring and use equipment from the apartment into the general areas within the building.
  • The operation of additional, private radiators of any kind is prohibited. To reduce any kind of wasted energy, windows should not be kept permanently open or tilted during the heating season.
  • Before using electrical devices, check if they are suitable for the national voltage of 220 to 230 volts. A safety seal of a globally recognised organisation (e.g. “CE”) may serve as an indication of compliance. If not, do not use them. It is forbidden by law to use electrical compliances that do not fulfil the State standards and/or are damaged. Guests will be personally liable for any damages caused by disrespect of this fundamental rule and could even face criminal prosecution.
  • Guests are not allowed to make any electro-technical changes to the sockets and other electrical installations. If a plug does not fit, use a mobile adapter plug that can easily be bought from an electrical goods store. Guests are fully liable for any damage caused by failure to comply with these provisions.
  • Sun protection systems are not to be used in bad weather.
  • For safety reasons and to avoid bad smells, the storage of objects, clothing, shoes, racks, waste, sports equipment, etc. in the common areas, especially in front of the Pop entrance door or in the corridors, or on the balcony is prohibited.
  • The disposal of solids, such as leftovers, hygiene articles, etc., through the toilet or other siphons is strictly prohibited. The costs incurred by disregarding this provision resulting in the demolition or malfunction of WCs and other siphons are fully charged to guests if they have caused the problem.
  • The use of the lift system must be carried out according to the regulations listed in the lifts and shall not be used, at any time, to transport heavy items. Transport of large goods in the lifts is not allowed. Lifts are designated to transport people, not objects. Guests are liable for damages to lifts due to improper or prohibited use. The emergency call installation in the lifts may only be used in case of emergency.
  • When using all the common areas of the City Pop building, please do it with care and clean up. Guests are obliged to leave a common area in a proper state, after use.

 

  1. Obligation to consider other Guests
  • From 10 p.m. to 7 a.m., the night-time quiet hours prescribed by the police apply. During the night-time quiet hours, disruptive activities and unnecessary noise are to be avoided in all areas in front of and inside the building.
  • Guests must avoid any actions that will disturb other Guests, such as slamming doors, talking out strikingly loud in common areas or in your Pop, etc. City Pop 2NIGHT reserves the right to act if these rules are not respected.
  • Sound reproduction devices of any kind are to be operated in the Pop at a customary domestic noise level. Common areas may not be used for the operation of sound reproduction equipment, not for private concerts, not for other performances and not, if not privately bookable for such kind of leisure activity, for private parties with exclusive groups of persons. Multi-person singing events or band rehearsals in the Pop or in the common areas are not permitted.
  • To respect the peace and quiet of everyone, playing music with any kind of musical instruments is not permitted. Amplifier systems for musical instruments are not allowed to be used in the Pop and in the common areas. Striking private singing is equivalent to making music with musical instruments.
  • Smoking, including vaping, is prohibited throughout the building. Open fires, candles, sparklers, incense sticks, and other similar ignition sources, may not be lit anywhere in the building. The guest responsible is fully liable for the costs incurred for alarm calls to the fire brigade and police. We reserve the right to claim further damages. Any violation of the no-smoking policy will result in a penalty of CHF 200.00. If the fire alarm is activated as a result of smoking, the CHF 200.00 no-smoking penalty will be charged in addition to the CHF 2,000.00 false fire alarm penalty, for a total of CHF 2,200.00.
  • Keeping pets is prohibited. There is no entitlement to the grant of an exception. If you keep a pet contrary to the contract, which leads among other things to noise or odour nuisance for the other Guests and/or to extensive wear and tear or to damage to the Pop, this represents a fundamental breach of contract, which authorises City Pop 2NIGHT to terminate the contract immediately.

 

  1. Waste Management
  • Waste disposal and the proper handling of garbage bags are Guests’ responsibility.
  • Depending on the location of City Pop 2NIGHT, only official, paid-for garbage bags may be used: buy them in the main grocery stores of the city or in the appropriate sales centres. Only official, payable garbage bags may be deposited (if supplied) in the container systems of City Pop 2NIGHT. If containers are not supplied by City Pop 2NIGHT or not available at the Site, you must dispose all waste in the waste disposal facilities provided and managed by the Community where the City Pop 2NIGHT Site is located. Illegal dumping will be penalized by the Police.
  • There are maybe State-run, freely usable collection points for valuables such as glass, metal, waste oil, PET and other plastics, clothes, shoes etc. For more information and instructions, please visit the appropriate community websites and contribute with green and respectful behaviour for our environment and beautiful world.
  • The garbage bins supplied in the City Pop 2NIGHT are only meant for the waste accumulated in the specific location where the waste bin is located, and not for dumping your personal waste accumulated in your Pop.
  • Leaving garbage bags or waste of any type within the building (including floors, common areas, etc.), not properly deposited in the designated waste containers, or disposing of waste randomly outside the building (garden, entrance, etc.) is strictly prohibited and may result in a Police sanction (fine). In addition, if waste is left outside the designated waste room or containers, a penalty of CHF 150.00 will be charged.

 

  1. Moisture
  • Guests must follow the safeguarding rules that are to be carried out at least daily or every time, when necessary, as proper ventilation and full regeneration of the air in the Pop is essential to avoid the formation of unhealthy mould in the Pop.
  • The residual moisture caused by the operation of wet rooms or by boiling is to be removed by intensive daily ventilation. Intensive ventilation means the complete opening of all windows (but not of the front door) for five to a maximum of ten minutes, three times a day.
  • Guests are responsible for the formation of mould in your Pop if the specified safeguard rules are not observed or if the mould is caused by careless use of the Pop. In that case guests will bear the costs if damages occur and if reparation or replacements are needed.

 

  1. Security
  • For emergencies, contact public emergency services first (police/fire/medical). For operational support (lockout, access code issues, maintenance), use the contacts provided during check-in or email [email protected]. Remote support operating hours and response targets are displayed in the App and may vary by location. City Pop 2NIGHT does not provide on‑site staff at all times and the building does not have specially trained security personnel who could be contacted in case of an emergency.
  • In case of criminal incidents (break-ins, threats, etc.), immediately and directly call the local Police on the emergency number. City Pop 2NIGHT must be notified via the Communication Channels or email.
  • All guests must familiarise themselves with the evacuation plan displayed on the wall when they first enter 2NIGHT Pop.
  • In case of open fire or of unidentified smoke smelling like fire (electrical cables burning etc.), the local fire brigade must be informed immediately on the emergency number and/or the fire emergency button must be pressed. City Pop must be informed via the Communication Channels or email. Your own efforts to extinguish the fire are only to be undertaken in the event of a trivial incident where there is no security risk for any people in the building. Even in case of minor doubts, call the fire brigade.
  • In case of medical emergencies, life-saving measures must be initiated immediately, and the local medical service must be contacted by telephone. City Pop 2NIGHT must be informed via the communication channels or email.
  • The front door is locked throughout the day so that unauthorised third parties have no access. Exceptions apply (e.g. opening times for post and parcel deliveries). Access to the building is only possible using their personal code and it is not monitored by City Pop 2NIGHT personnel.
  • The existing monitoring systems does not allow, inter alia, for data and privacy reasons, a monitoring of all areas and a permanent storage of recordings. You acknowledge and agree that the existing security systems will be operated. For more info, please read the detailed City Pop 2NIGHT Video Surveillance Privacy Policy.
  • In the following cases, zero tolerance applies: trade in drugs and illicit substances, arms trafficking, money laundering or counterfeiting activities, commercial activities with a sexual background. If there are any signs of these zero tolerance activities, City Pop 2NIGHT will call the Police. Guest/s involved in such zero tolerance activities will be evicted from the building immediately. There is no claim for reimbursement by the evicted Guest/s. City Pop 2NIGHT will issue the final bill statement as if the evicted Guest/s had voluntarily left the Pop early. The evicted Main Guest owes City Pop 2NIGHT any remaining balance and compensation according to the final bill statement, including any costs incurred by the authorities.
  • City Pop 2NIGHT reserves the right to control the security system in all Pop’s in case of damage to the building (within or outside, damage to other Guest’s Pop or similar cases, etc.).

 

  1. Lost and found
  • Items found in Pops or common areas are logged and stored for up to 30 days, unless perishable or hazardous. To reclaim an item, Guests must contact City Pop by writing to [email protected], provide a description, stay details and shipping address. Return shipping and handling are at the Guest’s cost and must be prepaid. Unclaimed items after the retention period are donated or disposed of responsibly. City Pop 2NIGHT assumes no liability for loss or damage of found items except as mandated by law.

 

  1. Summary of Fees and Penalties

To ensure the safety, cleanliness, and comfort of all residents and guests, as well as the proper maintenance of the property and its facilities, charges and penalties may apply in the event of policy violations, damages, or improper conduct. These measures are intended to protect the community and ensure compliance with house rules and applicable regulations. Below there is a summary of applicable charges of these T&Cs.

  • False fire alarm triggered by guest behaviour (e.g., smoking, misuse of equipment): CHF 2,000.00, plus any emergency services costs where applicable.
  • Violation of the no-smoking policy (including vaping): CHF 200.00. If the violation triggers a false fire alarm, a total of CHF 2,200.00 will be charged.
  • Waste left outside designated areas or waste rooms: CHF 150.00, plus any external fines or sanctions imposed by authorities.
  • Excessive cleaning beyond the standard level (e.g., heavily soiled apartment/Pop): Charges will apply as per itemized invoice and may be offset against the Security Deposit Hold or charged to the registered card.
  • Damage to inventory, installations, lifts, or common areas: Repair or replacement at cost, plus administrative fees; may be offset against the Security Deposit Hold.
  • Unapproved late check-out: Late departure fee (CHF 70.00) and/or charge of an additional night.

Czech Republic

CITY POP 2NIGHT TERMS AND CONDITIONS

The following Terms and Conditions (“T&C“) represent the contract between Guests and City Pop a.s. (“City Pop 2NIGHT“). Guests agree to read and to electronically confirm the T&C, and by having done that all Guests declare that they have understood and agree to all T&C provisions contained herein, prior to concluding any contract.

 

  1. City Pop 2NIGHT
  • 1.1   City Pop a.s., a joint-stock company, ID No. 139 63 902 established and existing under the laws of the Czech Republic, with its registered seat at Rybná 716/24, Staré Město, 110 00 Prague 1, the Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague, File No. B 26774, by virtue of its agreement with the building owner, is the operator of the building for which these T&C apply.
  • 1.2   City Pop 2NIGHT provides fully furnished (see section 6) apartments or rooms (“Pops“) for stays starting from one night with fixed comforts included in the booking price plus additional comforts available for an extra fee.
  • 1.3   City Pop 2NIGHT reserves the right to check the guest’s creditworthiness within the usual scope. By making a booking request, the guest gives City Pop 2NIGHT the consent to do so.
  • 1.4   Guests can contact City Pop 2NIGHT through WhatsApp, email ([email protected]) or phone.
  • 1.5   Members of the City Pop 2NIGHT Team have the right to enter the Pop within the course of their duties. In case justifiable reasons (e.g. cleaning, adjust the temperatures and change the setting of the heating etc.), the Pop may be entered without the Guest’s presence. City Pop 2NIGHT will inform in advance the Main Guest through email or SMS or WhatsApp message when a City Pop 2NIGHT Team will enter the Pop. In case of emergency the Pop might be accessed any time.

 

  1. Guests
  • 2.1   When referring to Guests in the T&C, provisions apply to both the Main Guest and the Additional Guest(s). Additional Guests are only those registered by the Main Guest within the booking process, during check-in.
  • 2.2   The 2NIGHT Pop booked may only be used by guests who have been registered and accepted in advance by City Pop.
  • 2.3   Guests are temporary users of 2NIGHT Pop. The booking guest is responsible and liable for any Additional Guest. Each adult and each child counts as one person.
  • 2.4   When booking, the guest must specify the number of people who will be staying in the accommodation – including any persons who do not stay overnight but are present in the Pop. The maximum number of people specified at the time of booking may not be exceeded for contractual, structural and legal reasons, and in particular for police reasons.
  • 2.5   Children count fully toward maximum occupancy. No extra beds, cots, or child‑specific equipment are provided unless explicitly listed for that Pop. Occupancy limits are strictly enforced for safety and legal compliance.
  • 2.6   The Main Guest is obliged to fully and truthfully complete the booking request providing the mandatory data for every guest, such as name and surname, personal contacts (email address and phone number), residence (country, city and home address), nationality and date of birth. Also, the uploading of a valid document for each guest (passport or identity card) together with the indication of both the expiration date and the issuing country is required. If not done properly, no check-in will be possible, neither for the Main Guest, nor for any Additional Guest/s. For identity documents that do not use the Latin alphabet, an officially verified translation must be uploaded.
  • 2.7   The email address provided by the guest at the time of booking must be used for further communication between the guest and City Pop 2NIGHT.
  • 2.8   False information provided during or after the booking, particularly a breach of the guest’s reporting obligations, shall be considered a serious breach of contract and shall entitle City Pop 2NIGHT to terminate the contract immediately without the guest being entitled to a refund. We reserve the right to claim any further damages.
  • 2.9   Bookings by third parties for a guest are possible, provided that the third party is related to the guest or is responsible for them (subject to valid legal or contractual representation). Other bookings by private third parties for other guests are not permitted.
  • 2.10   Bookings by commercial agents for their own customers are permitted if these agents have concluded in advance a corresponding cooperation agreement with City Pop 2NIGHT.

 

  1. Guests’ reporting obligation
  • 3.1   If the personal status of the guests or other information provided at the time of booking (personal data, addresses, telephone numbers, etc.) changes during the stay, the guest must notify City Pop 2NIGHT immediately and without being asked.
  • 3.2   The guest shall be liable for any defects in the inventory, in permanently installed fixtures and in the buildings that are not reported immediately upon moving in, which are present at the time of moving out and which were not already known to City Pop 2NIGHT.

 

  1. Fixed contract term
  • 4.1   The booking of a 2NIGHT Pop is made for the fixed contract term as shown in the booking confirmation.
  • 4.2   Once the reservation has been confirmed, the customer is obliged to pay for the stay in accordance with the conditions stated. Cancellation fees may apply depending on the booking rate and policy.
  • 4.3   Special offers that have been booked cannot be cancelled. There will be no refunds for special offers that have already been booked and paid for.
  • 4.4   If a guest decides to extend his stay, a new booking must be made.
  • 4.5   Any extension of the length of stay will be reported to the authorities as required by law.
  • 4.6   An extension of the stay does not entitle the guest to remain in the 2NIGHT Pop previously used. During the booking process, the guests will be informed about which 2NIGHT Pop can be booked.

 

  1. Permitted purpose of use
  • 5.1   The booking is valid for a 2NIGHT Pop for the fixed number of registered people with fixed amenities included in the booking confirmation.
  • 5.2   The booking entitles the guests to use the booked accommodation and the included amenities for the registered number of people.
  • 5.3   There will be no refund for amenities booked but not used.
  • 5.4   The Pop must be used exclusively for short- and medium-term accommodation purposes. Any other purposes of use are not permitted.
  • 5.5   In particular the Pop must not be used for commercial purposes and the address of City Pop 2NIGHT may not be used as a business address.
  • 5.6   All commercial activities that lead to increased traffic of people or goods (or otherwise cause disruptive emissions [e.g. noise, smells, light, vibrations etc.], including but not limited to paid consulting services, paid lessons, paid training and courses, wellness services (massages, sexual services, etc.) and a permanently installed business operation with passenger and/or freight traffic, are not permitted in the 2NIGHT Pop and in the generally accessible areas.
  • 5.7   The general facilities and 2NIGHT Pop can be viewed on the website as examples. City Pop does not guarantee the permanent availability of general facilities (subject to maintenance, repairs, changes to facilities, etc.) or the availability of 2NIGHT Pop shown as examples on the website at any time.

 

  1. Comforts included in the price

6.1. Cleaning

  • 6.1.1   Standard cleaning is included in the booking price, and its frequency is stated in the booking process and on the website. If the guest wishes to know more about the cleaning policies, he may contact City Pop 2NIGHT by mail.
  • 6.1.2   The cleaning team does not tidy up the 2NIGHT Pop and does not clean areas occupied by guests’ belongings.
  • 6.1.3   Standard cleaning frequency is displayed during booking. Unless otherwise stated, housekeeping does not include dishwashing or tidying of personal belongings.

 

6.2. Appliances, equipment and facilities

  • 6.2.1   Depending on the location and the type of accommodation booked, Pops have Wi-Fi, Smart TV, furniture, including customary mattress and bedding (pillows and blankets), bathroom, kitchenette or kitchen with customary amenities (cutlery, kitchen utensils) and home textiles (bath and hand towels, kitchen towels, bed linen). Some Pops do not have kitchenette with customary amenities and the Pop assigned will be coherent in terms of amenities with the one booked.
  • 6.2.2   City Pop 2NIGHT does not offer single beds in any Pop. All accommodations are equipped exclusively with the standard bed configuration indicated in the room description at the time of booking. It is not possible to request single beds, additional individual beds, or modifications to the existing bed setup. Guests acknowledge that the sleeping configuration cannot be altered and that no alternative bed types are available.
  • 6.2.3   The household textiles are property of City Pop 2NIGHT or its partners. The household textiles must be returned at the check-out in the same undamaged state how they were provided at the check-in.
  • 6.2.4   The in-house, common facilities are intended for usage by Guest/s, exclusively. Third parties from outside the building, or friends not using booked 2NIGHT Pop or any associates of the Guest/s are not entitled to regular use.
  • 6.2.5   Where facilities are available for all Guests, a “first come, first served” principle applies. The right to use such common facilities is not exclusive and they can only be used subject to availability.
  • 6.2.6   The voluntary non-usage of included comforts does not entitle the Guest/s to a price reduction.

 

6.3. Internet use

  • 6.3.1   City Pop 2NIGHT’s free Wi-Fi includes Internet access and unlimited data usage.
  • 6.3.2   City Pop provides a standard provider service. Reliable data on data transmission speed is not available, and guarantees are not possible, since this depends on factors over which City Pop 2NIGHT has no influence, as the general network stability and network utilization within and outside of the building. Therefore, City Pop 2NIGHT shall not be liable for any unavailability, interruptions, or reduced performance of the internet connection.
  • 6.3.3   The use of the Wi-Fi network (“Network”) provided at the City Pop 2NIGHT site is governed by the Wi-Fi Terms and Conditions described at point 8 in detail. By connecting and using the Network, Guest/s agree to comply with these terms.

 

6.4. Common areas

  • 6.4.1   Depending on the location, in-house common areas and other locations, Co-Liv, which are available free of charge at the respective City Pop 2NIGHT site, are not for individual Guests’ exclusive use.
  • 6.4.2   Where available, Co-Liv spaces are ruled by special conditions (binding house rules and/or leaflet) stated in the “City Pop Housing Rules”.
  • 6.4.3   The in-house common areas are to be used exclusively for ordinary leisure activities. In particular, no political or religious events can be organized or any other activities that are incompatible with the permitted purpose of use.

 

6.5. Breakfast

  • 6.5.1   Depending on the location, B&B rates may also be available. In case guests select this kind of option, breakfast will be included in the price. In this case, the voluntary non consumption of breakfast doesn’t allow a price reduction.

 

6.6. Luggage storage

  • 6.6.1   Depending on the City Pop 2NIGHT location, also a luggage storage may be available.
  • 6.6.2   Luggage storage is offered solely for temporary use in relation to a confirmed stay and may not be used as an ongoing or permanent storage solution. Any items left beyond the agreed stay period may be removed and may incur additional charges.

 

  1. Additional comforts/payable additional services
  • 7.1   The range of payable additional services is different depending on the location of the City Pop 2NIGHT. To include an additional service to the stay, the Main Guest uses the specific Guest App section. References in these Terms & Conditions to the “App” do not refer to the City Pop mobile application available in the Apple App Store or Google Play Store. For City Pop 2NIGHT stays, “Guest App” means the secure online webpage made available to Guests after successful completion of the digital check‑in process. This online portal provides access to essential stay information, additional services, instructions, and communication tools. Access to this webpage is personal, browser‑based, and linked to the Guest’s reservation; it does not require the download of any mobile application. Payment must be made immediately by credit card, except for the services for which payment must be completed through the third-party provider’s app.

7.2. Self-service laundry

  • 7.2.1   Depending on the City Pop 2NIGHT location, self-service washing machines and tumble dryer may be available in the building. These facilities can be used by all Guests. Terms of use, prices, payment method and instructions for use are available on the third-party provider’s app or website.
  • 7.2.2   Depending on the City Pop 2NIGHT location, the laundry service can be booked via the provider’s app or by scanning a QR code located in the laundry room.

 

7.3. Ironing Station

  • 7.3.1   An ironing station is available for all Guests and can be used during the stay. Equipment must be handled with care and returned to its original condition after use. In case of malfunction or damage, please report it immediately.

 

7.4. Final Cleaning

  • 7.4.1   The final cleaning is mandatory for all stays above 28 nights, and the costs will be shown to the Main Guest at the time of the booking. These costs will be displayed separately. At the time of check-out, if the room requires additional cleaning time compared to normal standards due to its condition, City Pop 2NIGHT reserves the right to apply an extra charge to cover the associated cleaning costs, which will be deducted from the Main Guest’s deposit, without express consent requirement by the Main Guest.

 

7.5. Parking Lots

  • 7.5.1   Bookable Parking Lots for vehicles are available in certain City Pop locations. The Parking Lots are not monitored. City Pop will neither be liable for theft nor for burglary.
  • 7.5.2   The booking of a Parking Lot without an accommodation being booked at the same time is usually not possible.
  • 7.5.3   It is not allowed to stock personal items on a Parking Lot. Cars or motorcycles/bicycles are the only vehicles permitted to park. Payable charging facilities might be available.
  • 7.5.4   Subject to availability, Parking Lots can be booked as additional payable comfort during the booking request and/or during your stay either for the entire or for the remaining duration of the stay, or else for a shorter period.

 

  1. Internet connection
  • 8.1   The use of the Wi-Fi network (“Network”) provided at City Pop Sites is regulated by the following Wi-Fi Terms and Conditions as mentioned in clause 6.3.3. By connecting to and using the Network, Guest/s agree to comply with these terms and conditions. Failure to do so may result in suspension of access, termination of services, or legal action where applicable.

8.1.1. Fair Usage Policy

  • The Wi-Fi service is provided as a shared resource for all Guests to use fairly and responsibly.
  • Bandwidth is not unlimited and excessive usage that negatively impacts other users (e.g. prolonged streaming, large downloads, or hosting servers) is forbidden.
  • The Network is intended for personal use only. It must not be used for commercial activities, reselling bandwidth, or operating a business.
  • Streaming, gaming, video calls, and downloading are permitted within reasonable limits that do not disrupt the overall Network performance.
  • The building management or network administrator reserves the right to limit speeds, block certain applications, or implement traffic management measures if usage patterns negatively impact the service for others.

 

8.1.2. Prohibited Activities

Guest/s must not engage in any activities that are illegal, harmful, or disruptive to the Network. Prohibited actions include, but are not limited to:

8.1.2.1. Malicious and Illegal Use

  • Hacking, unauthorized access, or penetration testing of any system or network.
  • Distribution of malware, viruses, or phishing attempts.
  • Engaging in cybercrime activities, such as fraud, identity theft, or unauthorized data collection.
  • Any use that violates local, national, or international laws, including copyright infringement, hacking, or illegal downloading.

8.1.2.2. Network Abuse

  • Using the Network to send spam, unsolicited communications, or bulk messages.
  • Running servers, torrents, or high-bandwidth applications that degrade network performance.
  • Attempting to bypass security measures or gain unauthorized access to other devices.

8.1.2.3. Inappropriate or Offensive Content

  • Hosting, sharing, or distributing offensive, defamatory, obscene, or illegal content.
  • Engaging in activities that promote violence, discrimination, or hate speech.

 

8.1.3. Monitoring and Enforcement

  • The building management or network administrator reserves the right to monitor traffic patterns to ensure compliance with this policy.
  • If a Guest is found to be in violation of this policy, actions may include: warning or temporary suspension of access; permanent disconnection from the Network; legal action, including reporting to authorities for criminal activity.
  • The Network is not guaranteed to be secure, and users are responsible for their own cybersecurity measures, such as using firewalls, VPNs, and strong passwords.

 

8.1.4. Limitation of Liability

  • The Wi-Fi service is provided on an “as is” and “as available” basis, with no guarantees of uptime, speed, or uninterrupted service.
  • The building management is not responsible for any data loss, hacking incidents, or security breaches that occur on the Network.
  • Guest/s assume all risks associated with connecting personal devices to the Network.
  • 8.1.5   Changes to Terms: these terms may be updated periodically to reflect changes in policies, security measures, or legal requirements. Continued use of the Wi-Fi Network constitutes acceptance of the latest terms applicable. For inquiries or to report network abuse, contact City Pop.
  • 8.2   Guest/s must comply with all applicable laws and regulations when using the shared internet connection according to City Pop Internet Connection Acceptable Use Policy.

8.2.1. The following activities are strictly prohibited:

  • Unauthorized access to or use of data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without express authorization.
  • Sharing the internet connection with individuals outside of the group of authorized users.

8.2.2. To ensure equitable access to the shared internet connection, this policy is in place:

  • Each user is allocated a specific speed capacity that can be up to 100 Mbps / device.
  • Activities that consume excessive bandwidth, such as large file downloads, and peer-to-peer file sharing, should be limited to off-peak hours to avoid congestion and ensure fair usage for all users.
  • The provider reserves the right to monitor data usage and take necessary actions to prevent abuse of the shared internet connection, including throttling bandwidth, terminating access for users who repeatedly engage in prohibited activities.

8.2.3. Maintenance Policy

To ensure the optimal performance and reliability of the shared internet connection, City Pop will adhere to the following maintenance policy and thus 3 types of maintenance windows might occur during your stay.

  • Scheduled Maintenance: Regular maintenance will be conducted during off-peak hours to minimize disruption. You will be notified at least 48 hours in advance of any scheduled maintenance that may impact service availability.
  • Emergency Maintenance: In the event of unexpected issues or urgent security threats, City Pop may perform emergency maintenance without prior notice. Users will be informed as soon as possible about the nature of the emergency and the expected duration of the maintenance.
  • Service Interruptions: During maintenance periods, users may experience temporary interruptions or reduced performance. City Pop will make reasonable efforts to complete maintenance tasks promptly and restore full service quickly.
  • 8.3   User Support: If users encounter connectivity issues or require assistance during maintenance periods, they should contact City Pop.
  • 8.4   The provider will offer timely updates and support to address any concerns or problems that arise due to maintenance activities.
  • 8.5   Infrastructure Upgrades: periodically, the provider may upgrade the network infrastructure to improve service quality and performance. Users will be informed of major upgrades and any potential impacts on their internet connection in advance.
  • 8.6   By agreeing to these terms and conditions, users acknowledge and accept that occasional maintenance is necessary for the upkeep and enhancement of the shared internet connection and agree to comply with the policies outlined above.

 

  1. Booking process
  • 9.1   Guests wishing to stay in a City Pop 2NIGHT Pop can check the availability of the accommodations and follow the booking process directly through City Pop 2NIGHT official website (citypop.com) or through third party booking platforms.
  • 9.2   Regardless of the channel used to make the booking, the Guest remains fully subject to the City Pop 2NIGHT Terms & Conditions.
  • 9.3   Regardless of the channel used, Guests must provide the necessary information and evidence to complete the booking.
  • 9.4   The option to book additional, chargeable comforts depends on the location of the City Pop 2NIGHT property. Guests will be informed and will be allowed to book any additional comforts available at an extra cost during the booking process or subsequently in the Guest App (available only after completion of the check-in process).
  • 9.5   After completing the booking application, the Main Guest must fully complete the mandatory identification procedure during the check-in process. In case the guest fails in completing the procedure this constitutes a serious material breach of the preconditions to conclude a contract, and the booking process can be terminated with immediate effect without any compensation.
  • 9.6   Whenever the identification process is not completed for all Guests, no access to the 2NIGHT Pop will be granted to the Guest/s.
  • 9.7   The application will be declined if the Main Guest is below 18 years old or if accompanying minors are not relatives of the Main Guest. The granting of exemptions requires the consent of the legal guardian(s) of the minor.
  • 9.8   Application will be declined if Guest/s have non-valid or expired legal documents (ID, Passport, Visa etc.).
  • 9.9   Application will be declined if Guest/s have compromised or false legal documents, namely whether a document is publicly available or known as compromised or it has been reported as used in a suspicious way.
  • 9.10   Application will be reviewed if some parameters do not fully satisfy the ID verification internal procedure.
  • 9.11   Payment must be made according to the payment policy and method stated during the booking process. Cash payments are not accepted. Receipt of payment is a prerequisite for the legal validity of the booking. Regardless of any confirmation, City Pop 2NIGHT is not bound by the booking if the payment is not received by City Pop 2NIGHT as agreed. Guest remains fully liable since the booking confirmation has taken place.
  • 9.12   Cancellation and amendment conditions are rate‑dependent and are displayed during the booking journey and on the confirmation. Non‑refundable rates cannot be cancelled, amended, or refunded. Flexible rates may be cancelled or amended free of charge until the deadline shown at booking; after the deadline, the charges shown for the selected rate apply. A no‑show is treated as a late cancellation under the booked rate conditions. Refunds (when applicable) are processed to the original payment method; processing times depend on the payment provider.
  • 9.13   Reservations made via Online Travel Agencies follow the no‑show definitions and financial rules set by the respective platform. City Pop 2NIGHT applies the same no‑show charges stated in the OTA rate selected by the Guest.
  • 9.14   Corporate and relocation bookings may follow negotiated terms regarding cancellation, invoicing, check‑in handling, and communication procedures. These agreed terms prevail over the standard T&C only if expressly stated in the written corporate agreement.
  • 9.15   The access code to enter the Pop will be given only after the check-in procedure. Any additional statutory charges or fees or additionally ordered services will be shown separately at the time of booking.
  • 9.16   The information provided by the Guest/s with the application will be processed and stored in accordance with the legal provisions and will be treated according to City Pop Privacy Policy (citypop.com/privacy-policy) in accordance with the applicable legal regulations at the relevant Site. Any notification to authorities etc. is made in accordance with the statutory provisions.
  • 9.17   The information contained in the booking request will be used by City Pop to fulfill its reporting obligations to the police, municipal authorities and other competent organizations (e.g. tourist tax). These reports do not replace any additional registration requirements with the municipal authorities that will be up to the guest (if necessary).
  • 9.18   The Guest is hereby informed and aware that the pictures of the Pop on the Website and in Third Party Booking platforms refer to a real Pop at the Site, but these pictures may not correspond to the exact Pop booked. Not only the layout but also some decorative items or furniture arrangement may differ in the de facto booked and assigned Pop.
  • 9.19   City Pop reserves the right to assign the guest a different 2NIGHT Pop before or after check-in if the previously assigned Pop is damaged or inaccessible for other reasons. If the newly assigned Accommodation is cheaper than the previously assigned one, City Pop will refund the guest the difference in price. If the newly assigned 2NIGHT Pop is more expensive than the previously assigned one, City Pop 2NIGHT will waive any additional costs.
  • 9.20   In the event that the reserved room is unavailable at the time of check-in for any reason, City Pop 2NIGHT will make its best effort to arrange alternative accommodation of comparable standard at no additional cost to the guest. Should the guest refuse the proposed alternative or should City Pop 2NIGHT not be able to provide an alternative, City Pop 2NIGHT’s liability shall be limited to a refund of the unused nights. The guest shall not be entitled to any further compensation or damages.
  • 9.21   Depending on the City Pop location, City Tax or other mandatory tourism taxes may apply in accordance with binding local regulations. Guests are required to prepay these taxes (such as City Tax per night) during the booking process. City Pop collects these taxes on behalf of the local authority and subsequently transfers them accordingly. Guests are responsible for informing themselves about publicly available online resources provided by responsible authorities or public bodies, where they can find all necessary information regarding potential exemptions and other relevant details about local tourism laws. The same rules apply to all additional Guests, starting from their notified and registered day of arrival.
  • 9.22   City Pop reserves the right to decline a booking even after the Guest has received an automatic booking confirmation. The booking will be declined in due course, and this will entail a full refund of the amount paid.
  • 9.23   Failure to comply with mandatory reporting obligations and non-fulfilment of any legally binding requirements by the Guest constitute material breaches of the contract, which entitles City Pop to terminate the contract, immediately.

 

  1. Check-in and check-out

10.1. Check-in

  • 10.1.1   The City Pop 2NIGHT location is operated without on-site staff. The Guest will receive a notification to the email address provided so that they can complete the self-service check-in. The latest check-in time is specified in the listing available on the Website or in the external platform. If the third-party platform does not display the check-in time, it is guest responsibility to check the check-in times on the official website (Citypop.com). The booked 2NIGHT Pop can be accessed from 3 p.m. Access is keyless. An entry code will be provided on the day of check-in, only if the online check-in has been completed successfully.
  • 10.1.2   During self-service check-in, it is mandatory to enter the data of every guest, including personal data, in order to verify their identity, contact details and other legally required information. The scope of the required data disclosure and data collection depends on the locally applicable legal provisions. Data are collected in accordance with City Pop Privacy Policy (citypop.com/privacy-policy/).
  • 10.1.3   After successful completion of the self-service check-in, City Pop 2NIGHT will provide the Guest with essential information about the location (address, including street, number of the City Pop 2NIGHT property, postcode of the city and number of the 2NIGHT Pop assigned to the guest). Completion of the digital pre‑check‑in is mandatory. This includes ID verification, personal data submission and a valid payment card. The access PIN is generated and sent automatically on the day of arrival only after successful completion of all required steps. Without the completed pre‑check‑in, no access PIN can be issued, and the Guest cannot enter the Pop.

 

10.2. Check-out

  • 10.2.1   The Guest must leave the Pop on the last day of the agreed contract period. In the App and on the Website the check-out time is indicated.
  • 10.2.2   For the check-out, the Guest receives procedure instructions via email and, where applicable, via SMS or WhatsApp message. The Guest is obliged to inform City Pop 2NIGHT of any damage or destruction of the Inventory entrusted, before departing.
  • 10.2.3   Damage to or destruction of the Inventory, which exceeds normal wear and tear, and/or damage caused by improper use shall be charged to the Guest. The amount of compensation payable depends on the time value of the damaged or destroyed object(s), summing up to the amount of the repair costs plus the damage management costs of City Pop 2NIGHT.
  • 10.2.4   Guest/s must vacate the Pop completely and must take all their belongings.
  • 10.2.5   If Guest/s rented a storage box or a parking lot, they are responsible for emptying the storage box and moving the vehicle. The disposal costs for items left in the Pop, in the storage box or in the parking spot after the check-out time has elapsed will be charged to the Main Guest.
  • 10.2.6   After the Guest has vacated the Pop upon check-out, City Pop will carry out a control of the Pop and of the Inventory.

 

10.3. Early Check-In and Late Check-out

Early check‑in and late check‑out are subject to availability and may incur a fee. Unapproved late check‑out beyond the published time may lead to: (i) a late departure fee (EUR 50.00), and/or (ii) the charge of an additional night if the Pop cannot be made available for the next Guest, and (iii) reimbursement of demonstrable operational costs (e.g., rescheduled cleaning). Access codes may deactivate automatically at or after check‑out time.

 

  1. Booking price/payment & deposit amount
  • 11.1   Until the booking is confirmed, the price is not guaranteed and may be updated regularly. Once the booking is made, the price for that period will remain unchanged.
  • 11.2   The booking must be paid in advance, in accordance with the selected Payment Policy and payment plan. Please note that for certain instalment options, the payment plan differs and the full amount is not due immediately. The instalment schedule chosen at the time of booking (as per the applicable Payment Policy) and its related terms and conditions will apply.
  • 11.3   The total price and the applicable payment schedule are displayed during the booking process and in the booking confirmation. If the guest wishes to know more about the payment schedule, he may contact City Pop 2NIGHT by mail.
  • 11.4   The accommodation will not be made available if the total payment – including the deposit amount – has not been completed in accordance with the booking terms.
  • 11.5   Additional services are subject to the rates applicable at the relevant City Pop 2NIGHT property and must be paid in advance at the time of booking.
  • 11.6   Transactions made by credit card between the Guest and City Pop 2NIGHT are processed by an external operator, to whom the guest’s recorded credit card details are communicated.
  • 11.7   City Pop 2NIGHT may charge an amount (the “Security Deposit Hold“) on a valid payment card provided by the Main Guest in the amount displayed during the booking and/or online check‑in flows. This Hold is intended to secure potential costs arising from damage, excessive cleaning, policy breaches, unpaid amounts or additional services, or lost keys/badges.
  • 11.8   Following the Guest’s check-out, City Pop 2NIGHT will inspect the Pop and its Inventory. The Security Deposit Hold will be released in full provided no damage, missing items, excessive cleaning, policy breaches, or outstanding charges are identified. In the event of any such issues, City Pop 2NIGHT reserves the right to retain all or part of the Security Deposit Hold to cover the related costs. The release of any remaining amount will be processed after the inspection. The timing of the actual release of funds is subject to the card issuer and is outside City Pop 2NIGHT’s control.

 

  1. Payment arrears
  • 12.1   City Pop is entitled to terminate this contract (and take back possession of the 2NIGHT Pop) if the Guests fail to fulfil their obligations under this contract (additionally purchased amenities), including obligations relating to additional services purchased, provided that the guest has not remedied the breach shortly after receiving the notice of default from City Pop 2NIGHT.
  • 12.2   Upon termination of the contract or upon expiration of the booked and paid term, City Pop 2NIGHT is entitled to enter the accommodation for the purpose of clearing it, to pack up the guest’s belongings and move them to another location, to draw up an inventory and a list of damages, including disposal costs (labour plus disposal fee) for waste and depreciation, to lock up 2NIGHT Pop, to block further access and, after restoration, to make it available for booking by other Guests at a later date.
  • 12.3   City Pop 2NIGHT may, at its own discretion, contact the competent authorities in case of required circumstances.
  • 12.4   The guest is obliged to bear the additional costs incurred by City Pop 2NIGHT as a result of the unscheduled clearance. In particular, the guest is obliged to pay for the vacancy period during the remaining booking period (booking price for the contractually agreed period until the same 2NIGHT pop is booked by another guest, etc.).
  • 12.5   All additional costs incurred by the involvement of an official, the preparation of the inventory, additional disposal costs and the storage of the guest’s personal belongings (only items of value) or otherwise also be charged to the guest and shall be paid by them.
  • 12.6   The guest’s inventoried personal belongings of value (objects or documents that appear to be worthy of preservation according to local understanding, according to the autonomous, careful and comprehensible discretion of City Pop 2NIGHT) will be stored by the property for one month. During this period guests can collect their things at the property. City Pop 2NIGHT is not responsible for the dispatching of the belongings. It is fully responsibility of the guest for the pick-up arrangement.
  • 12.7   If the guest does not collect the stored items after one month, City Pop 2NIGHT is entitled to dispose of or recycle the items at its own discretion.
  • 12.8   The guest’s certificates and other identification documents shall be kept for 10 years at the guest’s expense. After this period, City Pop is entitled, but not obliged, to dispose of the guest’s certificates and other identification documents.

 

  1. Guests’ liability
  • 13.1   Guest/s are liable for damages caused by careless, improper or contractually adverse use of the Pop, the inventory, the equipment or the generally available facilities or installations. Liability applies both to the damage to property (repair costs for correcting the defect) and to the administrative costs incurred (organisation and monitoring of the defect’s rectification), the latter at cost price.
  • 13.2   Guest/s are liable for all damage to the building and its fixed installations and for all damage to property of third parties, that occur within the building and are caused by Guest/s.
  • 13.3   City Pop 2NIGHT may, at its own discretion and without legal obligation, propose a lump sum payment (e.g. the retail price or goodwill price or similar) to settle the claim and expedite the resolution process.
  • 13.4   Unauthorized changes of any kind to the inventory, installations and facilities by the guests in the 2NIGHT Pop or in the common areas are prohibited. The guest shall pay the costs incurred for the professional repair of unauthorized alterations and for replacement or restoration to proper conditions within 5 days of the invoice date (due date).
  • 13.5   In the event of a false fire alarm triggered due to Guest behaviour, including but not limited to smoking or misuse of fire safety equipment, a fee of EUR 500.00 will be charged (subject to further claims for damages).

 

  1. City Pop liability
  • 14.1   City Pop 2NIGHT is liable, within the scope of its own services, exclusively for its own, grossly negligent behaviour. Furthermore, City Pop 2NIGHT is not liable in cases of force majeure or for any kind of damage incurred by the Guests.
  • 14.2   City Pop 2NIGHT is not liable for any problems with access to the building, in the context of the local, possibly even extreme weather conditions (snow, ice, hail, heavy rain, etc.), since the safe use at any time cannot be guaranteed, and also the individual, weather-adequate equipment of Guest/s and the degree of familiarisation of Guest/s with the local climate can vary greatly.
  • 14.3   City Pop 2NIGHT ensures its own liability risks to the extent required by local laws.
  • 14.4   If, despite reasonable efforts, a booked service is exceptionally unavailable for a longer period of time, the guest is only entitled to a discount in accordance with City Pop 2NIGHT’s usual practice for the period of non-use. No compensation is owed.
  • 14.5   City Pop 2NIGHT completely excludes liability for auxiliary persons to the extent permitted by law. City Pop 2NIGHT shall ensure the proper selection, instruction and supervision of auxiliary people within the framework of the legal requirements.
  • 14.6   City Pop 2NIGHT shall not be liable, regardless of value, for loss, theft or damage to the personal belongings of the guest (items, cash, other means of payment, etc.) unless this loss or theft has been proven to be caused by poor service on part of City Pop 2NIGHT. All Guests are required to keep valuables in locked cupboards, especially if not present in the Pop at the time when services are provided. All Guests are responsible for ensuring that high value items are adequately insured and/or sufficiently protected against access by unauthorised persons.
  • 14.7   City Pop 2NIGHT declines all responsibility for any damaged items owned by City Pop 2NIGHT on the City Pop 2NIGHT Site or of your own property, in your Pop, within the building or outside the building (washed and dried clothes in the laundry room, items stocked in the storage box, parked vehicle, etc.).
  • 14.8   If City Pop 2NIGHT is legally liable, this liability is limited to EUR 1,000.00 per incident.
  • 14.9   City Pop 2NIGHT shall not be liable for any failure or delay in performing its obligations if caused by events beyond their reasonable control, including but not limited to acts of God, natural disasters, epidemics/pandemics, governmental restrictions, strikes, civil unrest, utility outages not caused by the affected party, or failure of public services. Where performance is affected, obligations are suspended for the duration of the event.
  • 14.10   Certain services—including but not limited to laundry, digital check‑in, OTA booking platforms, identity verification providers and payment processors—are operated by third parties. City Pop 2NIGHT is not liable for interruptions, errors, or failures caused by such providers.
  • 14.11   The measures taken to ensure the safety of people and property are in accordance with customary local practices. There is no seamless monitoring of all generally accessible areas.

 

Amenities Warranty Disclaimer

  • All amenities, facilities, furnishings, equipment and services provided by City Pop 2NIGHT, whether located inside the Pop or in common areas, are offered on an “as available” and “as is” basis. City Pop 2NIGHT does not guarantee uninterrupted availability, specific performance, or the suitability of any amenity for a particular purpose.
  • Temporary unavailability of amenities—including but not limited to Wi‑Fi, common areas, lifts, laundry services, heating or cooling systems, lighting, kitchen equipment, or other building installations—may occur due to maintenance, repairs, technical failures, safety measures, or operational needs. Such temporary unavailability does not entitle the Guest to compensation, price reduction, termination of the contract, or any damages, except where mandatory law requires otherwise.
  • Guests use all amenities and common area equipment (including fitness devices, kitchen appliances, laundry equipment, and other shared installations) at their own risk. Guests are responsible for ensuring that they are physically able to use the equipment safely and must follow any displayed instructions, house rules, usage guidelines, and safety notices.
  • City Pop 2NIGHT is not liable for: misuse, improper handling, or unsafe operation of amenities by Guest(s) or third parties; personal injuries arising from voluntary use of amenities unless caused by proven gross negligence of City Pop 2NIGHT; failures or deficiencies caused by third‑party providers, public utility disruptions, or factors outside City Pop 2NIGHT’s control; inaccuracies or deviations between advertised amenities (including photos or examples) and the amenities actually available during the Guest’s stay.
  • Where an amenity is operated or provided by a third‑party supplier, the Guest may also be bound by that provider’s terms and conditions. City Pop 2NIGHT assumes no responsibility for interruptions, malfunctions, or unavailability resulting from third‑party services.

 

Completeness of the booking conditions/deviating agreements

  • The regulations applicable to the booking are set out conclusively in the property description, the information provided in the booking request, the booking confirmation, the General Terms and Conditions and the applicable statutory provisions. No other provisions apply. Furthermore, no verbal agreements exist, and such agreements are not permitted.
  • If the guest wishes to have special conditions and/or deviations from these General Terms and Conditions, these must be specifically and expressly agreed with City Pop 2NIGHT.
  • Any additional agreements with the guest in individual cases must be made in electronic form at a minimum, which must include the express acceptance and confirmation by City Pop 2NIGHT. Acceptance by tacit consent is explicitly excluded.
  • City Pop 2NIGHT is entitled to warn Guests, within the framework of these regulations, agreements and legal provisions, to comply with them and to issue corresponding instructions (right of instruction / house rules / code of conduct, etc.).

 

Updates to the T&C

City Pop reserves the right to change or modify the content of these T&C. Any new version will be available on the City Pop Website and shall take legal effect from the date of such posting. The Guests will be notified of any amendments by email to the address used for the booking. It is the Guest’s responsibility to regularly check their email account (including spam or junk folders) and to inform City Pop of any changes to their email address. Without written objection within 10 days, Guests are deemed to have accepted and agreed to the latest version of the T&C, as binding and applicable. Guests have the right to reject the change or modification to these T&C, in which case City Pop reserves the right to notify to the Guest that either the T&C change or modification shall not apply to the Guest, or that the T&C change or modification applies to them and the Guest is authorized to withdraw from the contract within 10 (ten) days from the notification.

 

Additional or missing provisions

If, during the booking period, a legally relevant issue has not been regulated or it has not been regulated sufficiently, or if a provision originally or subsequently does not prove to be legally feasible, the filling of the gap will be done primarily in analogy to the provisions already made and the economic intent and purpose, taking into account the economic balance between the Guests and City Pop 2NIGHT. The meaning and spirit of the previous booking and the associated provisions and agreements made shall be preserved as far as possible. The highest guideline is an appropriate, substitute, universally applicable, but also fair in a concrete individual case, solution that is appropriate for the operating concept of City Pop 2NIGHT.

 

Applicable law

  • Guests agree that bookings are purely digitally confirmed and processed. There is no requirement for a written copy and signature on the booking.
  • The law of the country where the City Pop 2NIGHT building operates is the applicable law that will apply to all matters involving all agreed contracts, if not ruled by the provisions of this T&C yet.
  • Exclusive and sole place of jurisdiction are the courts of the city in which the Pop is situated. If proceedings are brought in other jurisdictions, no statement of defence will be made, and all foreign decisions will be deemed null and void. Arbitration tribunals and other alternative litigation proceedings are expressly excluded.
  • Should City Pop 2NIGHT incur costs because of unauthorised claims by Guest/s at other places, at arbitration tribunals or other alternative litigation, Guest/s are obliged to fully pay all costs incurred in connection therewith, regardless of cost-bearing decisions in other, inadmissible proceedings.

 

Code of conduct and right of use

 

The code of conduct for City Pop 2NIGHT users ensures the peaceful coexistence of all guests. It is intended to enable all guests to have a pleasant and respectful stay. Every guest is obliged to comply with it. The main guest is responsible for any misconduct on the part of the other guests. With the booking confirmation, the guest confirms that they have understood the code of conduct. Significant or repeated non-compliance with the code of conduct by the guest and accompanying persons entitles City Pop 2NIGHT to terminate the contract.

 

20.1. Appropriate operation of the Pop, installations, furniture and equipment

  • 20.1.1   All guests are obliged to use the building, facilities and inventory with care and in the usual manner. Damage or destruction and the replacement costs must be compensated by the responsible guest. Guests should not carry out any independent repairs within the Pop, of installations, of other equipment or of furniture. Guests are obliged to report damages and any repairs required to City Pop 2NIGHT.
  • 20.1.2   Structural and furniture changes are strictly prohibited. The furniture must not be altered or damaged. Guests may bring in their own, movable, small furniture items, which may not be permanently mounted or installed in the Pop. The small furniture brought in may not damage the existing equipment or remaining furniture. The permanent installation of satellite dishes or other technical equipment as well as the insertion of further cables is prohibited.
  • 20.1.3   Guests are not allowed to remove from the apartment and/or give away any furniture, furnishings or equipment. It is also not permitted to bring and use equipment from the apartment into the general areas within the building.
  • 20.1.4   The operation of additional, private radiators of any kind is prohibited. To reduce any kind of wasted energy, windows should not be kept permanently open or tilted during the heating season.
  • 20.1.5   Before using electrical devices, check if they are suitable for the national voltage of 220 to 230 volts. A safety seal of a globally recognised organisation (e.g. “CE”) may serve as an indication of compliance. If not, do not use them. It is forbidden by law to use electrical compliances that do not fulfil the State standards and/or are damaged. Guests will be personally liable for any damages caused by disrespect of this fundamental rule and could even face criminal prosecution.
  • 20.1.6   Guests are not allowed to make any electro-technical changes to the sockets and other electrical installations. If a plug does not fit, use a mobile adapter plug that can easily be bought from an electrical goods store. Guests are fully liable for any damage caused by failure to comply with these provisions.
  • 20.1.7   Sun protection systems are not to be used in bad weather.
  • 20.1.8   For safety reasons and to avoid bad smells, the storage of objects, clothing, shoes, racks, waste, sports equipment, etc. in the common areas, especially in front of the Pop entrance door or in the corridors, or on the balcony is prohibited.
  • 20.1.9   The disposal of solids, such as leftovers, hygiene articles, etc., through the toilet or other siphons is strictly prohibited. The costs incurred by disregarding this provision resulting in the demolition or malfunction of WCs and other siphons are fully charged to guests if they have caused the problem.
  • 20.1.10   The use of the lift system must be carried out according to the regulations listed in the lifts and shall not be used, at any time, to transport heavy items. Transport of large goods in the lifts is not allowed. Lifts are designated to transport people, not objects. Guests are liable for damages to lifts due to improper or prohibited use. The emergency call installation in the lifts may only be used in case of emergency.
  • 20.1.11   When using all the common areas of the City Pop building, please do it with care and clean up. Guests are obliged to leave a common area in a proper state, after use.

 

20.2. Obligation to consider other Guests

  • 20.2.1   From 10 p.m. to 7 a.m., the night-time quiet hours prescribed by the police apply. During the night-time quiet hours, disruptive activities and unnecessary noise are to be avoided in all areas in front of and inside the building.
  • 20.2.2   Guests must avoid any actions that will disturb other Guests, such as slamming doors, talking out strikingly loud in common areas or in your Pop, etc. City Pop 2NIGHT reserves the right to act if these rules are not respected.
  • 20.2.3   Sound reproduction devices of any kind are to be operated in the Pop at a customary domestic noise level. Common areas may not be used for the operation of sound reproduction equipment, not for private concerts, not for other performances and not, if not privately bookable for such kind of leisure activity, for private parties with exclusive groups of persons. Multi-person singing events or band rehearsals in the Pop or in the common areas are not permitted.
  • 20.2.4   To respect the peace and quiet of everyone, playing music with any kind of musical instruments is not permitted. Amplifier systems for musical instruments are not allowed to be used in the Pop and in the common areas. Striking private singing is equivalent to making music with musical instruments.
  • 20.2.5   Smoking, including vaping, is prohibited throughout the building. Open fires, candles, sparklers, incense sticks, and other similar ignition sources, may not be lit anywhere in the building. The guest responsible is fully liable for the costs incurred for alarm calls to the fire brigade and police. We reserve the right to claim further damages. Any violation of the no-smoking policy will result in a penalty of EUR 200.00. If the fire alarm is activated as a result of smoking, the EUR 200.00 no-smoking penalty will be charged in addition to the EUR 500.00 false fire alarm penalty, for a total of EUR 700.00.
  • 20.2.6   Keeping pets is prohibited. There is no entitlement to the grant of an exception. If you keep a pet contrary to the contract, which leads among other things to noise or odour nuisance for the other Guests and/or to extensive wear and tear or to damage to the Pop, this represents a fundamental breach of contract, which authorises City Pop 2NIGHT to terminate the contract immediately.

 

20.3. Waste Management

  • 20.3.1   Waste disposal and the proper handling of garbage bags are Guests’ responsibility.
  • 20.3.2   Depending on the location of City Pop 2NIGHT, only official, paid-for garbage bags may be used: buy them in the main grocery stores of the city or in the appropriate sales centres. Only official, payable garbage bags may be deposited (if supplied) in the container systems of City Pop 2NIGHT. If containers are not supplied by City Pop 2NIGHT or not available at the Site, you must dispose all waste in the waste disposal facilities provided and managed by the Community where the City Pop 2NIGHT Site is located. Illegal dumping will be penalized by the Police.
  • 20.3.3   There are maybe State-run, freely usable collection points for valuables such as glass, metal, waste oil, PET and other plastics, clothes, shoes etc. For more information and instructions, please visit the appropriate community websites and contribute with green and respectful behaviour for our environment and beautiful world.
  • 20.3.4   The garbage bins supplied in the City Pop 2NIGHT are only meant for the waste accumulated in the specific location where the waste bin is located, and not for dumping your personal waste accumulated in your Pop.
  • 20.3.5   Leaving garbage bags or waste of any type within the building (including floors, common areas, etc.), not properly deposited in the designated waste containers, or disposing of waste randomly outside the building (garden, entrance, etc.) is strictly prohibited and may result in a Police sanction (fine). In addition, if waste is left outside the designated waste room or containers, a penalty of EUR 150.00 will be charged.

 

20.4. Moisture

  • 20.4.1   Guests must follow the safeguarding rules that are to be carried out at least daily or every time, when necessary, as proper ventilation and full regeneration of the air in the Pop is essential to avoid the formation of unhealthy mould in the Pop.
  • 20.4.2   The residual moisture caused by the operation of wet rooms or by boiling is to be removed by intensive daily ventilation. Intensive ventilation means the complete opening of all windows (but not of the front door) for five to a maximum of ten minutes, three times a day.
  • 20.4.3   Guests are responsible for the formation of mould in your Pop if the specified safeguard rules are not observed or if the mould is caused by careless use of the Pop. In that case guests will bear the costs if damages occur and if reparation or replacements are needed.

 

20.5. Security

  • 20.5.1   For emergencies, contact public emergency services first (police/fire/medical). For operational support (lockout, access code issues, maintenance), use the contacts provided during check-in or email [email protected]. Remote support operating hours and response targets are displayed in the App and may vary by location. City Pop 2NIGHT does not provide on‑site staff at all times and the building does not have specially trained security personnel who could be contacted in case of an emergency.
  • 20.5.2   In case of criminal incidents (break-ins, threats, etc.), immediately and directly call the local Police on the emergency number 112 or specific police emergency number 158. City Pop 2NIGHT must be notified via the Communication Channels or email.
  • 20.5.3   All guests must familiarise themselves with the evacuation plan displayed on the wall when they first enter 2NIGHT Pop.
  • 20.5.4   In case of open fire or of unidentified smoke smelling like fire (electrical cables burning etc.), the local fire brigade must be informed immediately on the emergency number 112 or specific fire brigade emergency number 150 and/or the fire emergency button must be pressed. City Pop must be informed via the Communication Channels or email. Your own efforts to extinguish the fire are only to be undertaken in the event of a trivial incident where there is no security risk for any people in the building. Even in case of minor doubts, call the fire brigade.
  • 20.5.5   In case of medical emergencies, life-saving measures must be initiated immediately, and the local medical service must be contacted by telephone. City Pop 2NIGHT must be informed via the communication channels or email.
  • 20.5.6   The front door is locked throughout the day so that unauthorised third parties have no access. Exceptions apply (e.g. opening times for post and parcel deliveries). Access to the building is only possible using their personal code and it is not monitored by City Pop 2NIGHT personnel.
  • 20.5.7   The existing monitoring systems does not allow, inter alia, for data and privacy reasons, a monitoring of all areas and a permanent storage of recordings. You acknowledge and agree that the existing security systems will be operated. For more info, please read the detailed City Pop 2NIGHT Video Surveillance Privacy Policy.
  • 20.5.8   In the following cases, zero tolerance applies: trade in drugs and illicit substances, arms trafficking, money laundering or counterfeiting activities, commercial activities with a sexual background. If there are any signs of these zero tolerance activities, City Pop 2NIGHT will call the Police. Guest/s involved in such zero tolerance activities will be evicted from the building immediately. There is no claim for reimbursement by the evicted Guest/s. City Pop 2NIGHT will issue the final bill statement as if the evicted Guest/s had voluntarily left the Pop early. The evicted Main Guest owes City Pop 2NIGHT any remaining balance and compensation according to the final bill statement, including any costs incurred by the authorities.
  • 20.5.9   City Pop 2NIGHT reserves the right to control the security system in all Pops in case of damage to the building (within or outside, damage to other Guest’s Pop or similar cases, etc.).

 

20.6. Lost and found

  • 20.6.1   Items found in Pops or common areas are logged and stored for up to 30 days, unless perishable or hazardous. To reclaim an item, Guests must contact City Pop by writing to [email protected], provide a description, stay details and shipping address. Return shipping and handling are at the Guest’s cost and must be prepaid. Unclaimed items after the retention period are donated or disposed of responsibly. City Pop 2NIGHT assumes no liability for loss or damage of found items except as mandated by law.

 

20.7. Summary of Fees and Penalties

To ensure the safety, cleanliness, and comfort of all residents and guests, as well as the proper maintenance of the property and its facilities, charges and penalties may apply in the event of policy violations, damages, or improper conduct. These measures are intended to protect the community and ensure compliance with house rules and applicable regulations. Below there is a summary of applicable charges of these T&Cs.

  • False fire alarm triggered by guest behaviour (e.g., smoking, misuse of equipment): EUR 500.00, plus any emergency services costs where applicable.
  • Violation of the no-smoking policy (including vaping): EUR 200.00. If the violation triggers a false fire alarm, a total of EUR 700.00 will be charged.
  • Waste left outside designated areas or waste rooms: EUR 150.00, plus any external fines or sanctions imposed by authorities.
  • Excessive cleaning beyond the standard level (e.g., heavily soiled apartment/Pop): Charges will apply as per itemized invoice and may be offset against the Security Deposit Hold or charged to the registered card.
  • Damage to inventory, installations, lifts, or common areas: Repair or replacement at cost, plus administrative fees; may be offset against the Security Deposit Hold.
  • Unapproved late check-out: Late departure fee and/or charge of an additional night.

 

Consumers

  • For Guests who are consumers, the provisions of this contract apply in full, with the exception of those provisions that are in direct conflict with the mandatory rules for consumer protection, as contained in particular in the Czech Civil Code and Act No. 634/1992 Coll., on consumer protection. A provision of the contract including a specifically consumer-only provision, different from the other provisions of these GTC, is located below in this section.
  • In the event that a consumer dispute arises between City Pop and the Guest who is a consumer which cannot be resolved by mutual agreement, the consumer may submit a motion for out-of-court resolution of such dispute to the designated consumer dispute resolution body, which is:

CITY POP 2NIGHT TERMS AND CONDITIONS

The following general terms and conditions (‘GTC‘) constitute the contract between Customers and City Pop SAS (‘City Pop 2NIGHT‘). Customers undertake to read and accept these GTC electronically; in doing so, all Customers declare that they have understood and accepted all the provisions of these GTC prior to the conclusion of any contract.

 

  1. City Pop 2NIGHT
  • 1.1   City Pop SAS, registered with the Nanterre Trade and Companies Register under number 908 939 481, with its registered office at 8 Rue d’Athènes, 75009 Paris, pursuant to its agreement with the property owner, is the operator of the property to which these GTC apply.
  • 1.2   City Pop 2NIGHT offers fully furnished flats or rooms (see section 6) (‘Pops‘) for stays of one night or more, with basic facilities included in the booking price and additional facilities available at an extra charge.
  • 1.3   City Pop 2NIGHT reserves the right to check the Customer’s creditworthiness in accordance with standard practice. By submitting a booking request, the Customer expressly consents to this check.
  • 1.4   Guests may contact City Pop 2NIGHT via WhatsApp, by email ([email protected]) or by telephone (+33 1 86 54 21 80).
  • 1.5   City Pop 2NIGHT staff members are authorised to access the Pop as part of their duties. Where there are valid reasons (for example, cleaning, adjusting the temperature and changing the heating settings, etc.), access to the Pop may take place in the Customer’s absence. City Pop 2NIGHT will notify the Main Customer in advance by email, SMS or WhatsApp message whenever a member of the City Pop 2NIGHT team enters the Pop. In the event of an emergency, access to the Pop may be authorised at any time.

 

  1. Clients
  • 2.1   Where reference is made to ‘Clients’ in these Terms and Conditions, the provisions apply to both the Main Client and any Additional Client(s). Additional Clients are solely those registered by the Main Client during the booking process, at the time of registration.
  • 2.2   The booked Pop may only be used by Guests who have been registered and accepted in advance by City Pop 2NIGHT.
  • 2.3   Guests are temporary users of the Pop 2NIGHT. The Main Guest who made the booking is responsible for any Additional Guests. Each adult and each child counts as one person.
  • 2.4   When booking, the Guest must specify the number of people who will be staying in the accommodation, including any person who is not spending the night there but is present in the Pop. The maximum number of people specified at the time of booking must not be exceeded, for contractual, structural and legal reasons, and in particular for safety reasons.
  • 2.5   Children are fully included in the maximum occupancy. No extra beds, cots or specific equipment for children is provided, unless this is explicitly stated for that particular Pop. Occupancy limits are strictly enforced for safety and legal compliance reasons.
  • 2.6   The Main Customer is required to complete the booking request fully and truthfully, providing the mandatory details for each Customer, such as full name, personal contact details (email address and telephone number), place of residence (country, town and address), nationality and date of birth. Furthermore, it is compulsory to upload a valid identity document for each Guest (passport or identity card), including the expiry date and country of issue. If this information is not provided correctly, registration will not be possible for either the Main Guest or any Additional Guests. For identity documents that do not use the Latin alphabet, a certified translation must be uploaded.
  • 2.7   The email address provided by the Customer at the time of booking must be used for all subsequent communication between the Customer and City Pop 2NIGHT.
  • 2.8   Any false information provided during or after the booking, in particular any breach of the Customer’s disclosure obligations, will be considered a serious breach of contract and will entitle City Pop 2NIGHT to terminate the contract immediately without the Customer being entitled to a refund. We reserve the right to claim any further compensation.
  • 2.9   Bookings made by third parties on behalf of a Customer are permitted, provided that the third party is affiliated with or responsible for that Customer (subject to valid legal or contractual representation). Other bookings made by private third parties on behalf of other Customers are not permitted.
  • 2.10   Bookings made by sales agents on behalf of their own Clients are permitted provided that such agents have first entered into a corresponding cooperation agreement with City Pop 2NIGHT.

 

  1. Customers’ duty to disclose information
  • 3.1   If a Guest’s personal circumstances or other information provided at the time of booking (personal details, addresses, telephone numbers, etc.) change during their stay, the Guest must inform City Pop 2NIGHT immediately and on their own initiative.
  • 3.2   The Guest is liable for any defects in the equipment, fixed installations and buildings that were not reported immediately upon arrival, which are discovered at the time of departure and which were not already known to City Pop 2NIGHT.

 

  1. Term of the contract
  • 4.1   A booking for a Pop is valid for the fixed contractual period as stated in the booking confirmation.
  • 4.2   Once the booking has been confirmed, the Customer is obliged to pay for the stay in accordance with the terms set out. The Customer is reminded that, in accordance with Article L. 221-28, 12° of the Consumer Code, they do not have the right of withdrawal provided for in Article L. 221-18 of the said Code. Cancellation fees may apply depending on the rate and booking terms.
  • 4.3   Special offers that have been booked cannot be cancelled. No refund will be made for special offers that have already been booked and paid for.
  • 4.4   If a Customer decides to extend their stay, a new booking must be made.
  • 4.5   Any extension of the length of stay will be reported to the authorities in accordance with the law.
  • 4.6   An extension of the stay does not entitle the Customer to remain in the Pop previously occupied. During the booking process, Customers will be informed of the Pops available for booking.

 

  1. Permitted Use
  • 5.1   A Pop booking is valid for a specified number of registered guests and includes the services included in the booking price.
  • 5.2   The booking entitles guests to use the accommodation booked and the services included, for the number of people registered.
  • 5.3   No refund will be given for services booked but not used.
  • 5.4   The Pop must be used exclusively for short- and medium-term accommodation. Any other use is prohibited.
  • 5.5   In particular, the Pop must not be used for commercial purposes, and the City Pop 2NIGHT address may not be used as a business address.
  • 5.6   Any commercial activity resulting in an increase in the flow of people or goods (or causing a nuisance, such as noise, odours, light or vibrations, etc.), including, but not limited to, paid consultancy services, paid courses and training, wellness services (massages, sexual services, etc.), as well as the operation of a permanent business involving the movement of people and/or goods, is prohibited within the Pops and in accessible communal areas.
  • 5.7   Under no circumstances does the Pop constitute a residential tenancy agreement. Consequently, the Customer may not invoke the legal provisions applicable to residential tenancies, in particular those relating to the right to remain in the premises.
  • 5.8   The communal facilities and the Pops featured on the website are shown by way of example only. City Pop 2NIGHT does not guarantee the permanent availability of communal facilities (particularly in the event of maintenance, repairs or alterations), nor that of the Pops shown by way of example on the website.

 

  1. Services included in the price

6.1. Cleaning

  • 6.1.1   Standard cleaning is included in the booking price, and the frequency is specified during the booking process and on the website. If the Customer wishes to find out more about the cleaning terms and conditions, they may contact City Pop 2NIGHT by post.
  • 6.1.2   The cleaning team does not tidy the Pop or clean areas occupied by guests’ personal belongings.
  • 6.1.3   The standard cleaning frequency is specified at the time of booking. Unless otherwise stated, the cleaning service does not include washing up or tidying away personal belongings.

 

6.2. Appliances, equipment and facilities

  • 6.2.1   Depending on the location and type of accommodation booked, Pops are equipped with Wi-Fi, a Smart TV, furniture including a mattress and standard bedding (pillows and blankets), a bathroom, a kitchenette or kitchen with standard equipment (cutlery, kitchen utensils) and household linen (bath and toilet towels, tea towels, bed linen). Some Pops do not have a kitchenette with the usual equipment. The Pop allocated will correspond, in terms of facilities, to the one booked.
  • 6.2.2   City Pop 2NIGHT does not offer single beds in its Pops. All accommodation is equipped exclusively with the standard bed configuration indicated in the room description at the time of booking. It is not possible to request single beds, additional single beds or changes to the existing bed configuration. Guests acknowledge that the bed configuration cannot be altered and that no other type of bed is available.
  • 6.2.3   Bed linen is the property of City Pop 2NIGHT or its partners. Bed linen must be returned on departure in the same intact condition as it was provided on arrival.
  • 6.2.4   The establishment’s communal facilities are intended for the exclusive use of Guests. Third parties not staying at the establishment, friends not staying in a booked Pop accommodation, or any other persons associated with the Guests are not permitted to make regular use of them.
  • 6.2.5   Where facilities are accessible to all Guests, the ‘first come, first served’ principle applies. The right to use these communal facilities is not exclusive and their use is subject to availability.
  • 6.2.6   The fact that the Guest(s) deliberately choose not to use the included facilities and services shall not entitle them to a reduction in price.

 

6.3. Internet access

  • 6.3.1   City Pop 2NIGHT’s free Wi-Fi includes internet access and unlimited data usage.
  • 6.3.2   City Pop 2NIGHT provides a standard internet service. There are no reliable figures regarding data transmission speeds, and no guarantee can be given, as this depends on factors over which City Pop 2NIGHT has no control, such as the general stability of the network and network usage both inside and outside the building. Consequently, City Pop 2NIGHT cannot be held liable for any unavailability, interruption or reduction in the performance of the internet connection.
  • 6.3.3   Use of the Wi-Fi network (‘Network’) provided at the City Pop 2NIGHT venue is governed by the Wi-Fi terms and conditions set out in full in clause 8. By connecting to and using the Network, the Customer(s) agree to comply with these terms and conditions.

 

6.4. Communal areas

  • 6.4.1   Depending on the specific City Pop 2NIGHT establishment, indoor communal areas and other ‘Co-Liv’ facilities – which may be accessible free of charge depending on the specific City Pop 2NIGHT establishment – are not reserved for the exclusive use of Guests.
  • 6.4.2   Where available, Co-Liv areas are subject to specific conditions (binding house rules and/or a brochure) set out in the ‘City Pop House Rules’.
  • 6.4.3   The establishment’s communal areas must be used exclusively for everyday leisure activities. In particular, no political or religious events may be organised, nor any other activity incompatible with authorised use.

 

6.5. Breakfast

  • 6.5.1   Depending on the City Pop 2NIGHT establishment in question, B&B (bed and breakfast) packages may also be offered. If Guests choose this option, breakfast will be included in the price. In this case, voluntarily not taking breakfast does not entitle the Guest to a price reduction.

 

6.6. Luggage storage

  • 6.6.1   Depending on the specific City Pop 2NIGHT property, a luggage storage service may also be available.
  • 6.6.2   Luggage storage is provided solely for temporary use during a confirmed stay and may not be used as a permanent or long-term storage solution. Any items left beyond the agreed period of stay may be removed and may incur additional charges.

 

  1. Additional services/additional paid services
  • 7.1   The range of additional services subject to a charge varies depending on the location of the City Pop 2NIGHT property. To add an additional service to their stay, the Lead Guest must use the relevant section of the Guest App. References to the ‘Guest App’ in these Terms and Conditions do not refer to the City Pop mobile app available on the Apple App Store or the Google Play Store. For City Pop 2NIGHT stays, the term ‘Customer App’ refers to the secure web page made available to Customers once the digital check-in process has been completed. This online portal provides access to essential information regarding the stay, additional services, instructions and communication tools. Access to this web page is personal, is via a web browser and is linked to the Customer’s booking; it does not require the download of any mobile app. Payment must be made immediately by credit card, with the exception of services for which payment must be made via the third-party provider’s app.

7.2. Self-service laundry

  • 7.2.1   Depending on the specific City Pop 2NIGHT property, self-service washing machines and tumble dryers may be available on the premises. These facilities may be used by all Guests. The terms of use, prices, payment methods and instructions for use are available on the third-party provider’s app or website.
  • 7.2.2   Depending on the specific City Pop 2NIGHT property, a laundry service may be booked via the service provider’s app or by scanning a QR code located in the laundry room.

 

7.3. Ironing

  • 7.3.1   An ironing board is available for all guests to use during their stay. Please handle the equipment with care and return it to its original condition after use. In the event of a fault or damage, please report it immediately.

 

7.4. End-of-stay cleaning

  • 7.4.1   Final cleaning is compulsory for all stays of more than 28 nights, and the corresponding charges will be communicated to the Main Guest at the time of booking. These charges will be shown separately. Upon departure, if the condition of the room requires additional cleaning time beyond the usual standards, City Pop 2NIGHT reserves the right to apply additional charges to cover the associated cleaning costs, which will be deducted from the Main Guest’s deposit without the need for the Main Guest’s express consent.

 

7.5. Car parks

  • 7.5.1   Reservable parking spaces for vehicles are available at certain City Pop 2NIGHT properties. The car parks are unstaffed. City Pop 2NIGHT cannot be held liable in the event of theft or burglary.
  • 7.5.2   It is generally not possible to book a parking space without simultaneously booking accommodation.
  • 7.5.3   It is forbidden to leave personal belongings in a parking space. Only cars, motorbikes and bicycles are permitted to park there. Paid charging points may be available.
  • 7.5.4   Subject to availability, parking spaces can be booked as an additional paid service when making your booking and/or during your stay, either for the entire duration of your stay, for the remaining duration, or for a shorter period.

 

  1. Internet connection
  • 8.1   Use of the Wi-Fi network (‘Network’) provided at City Pop 2NIGHT sites is governed by the general terms and conditions of use for Wi-Fi set out in clause 6.3.3 and detailed below. By connecting to and using the Network, the Guest(s) agree to comply with these terms and conditions. Any breach of this obligation may result in the suspension of access, the termination of services or legal proceedings where applicable.

8.1.1. Fair Use Policy

  • The Wi-Fi service is provided as a shared resource which all Customers must use fairly and responsibly.
  • Bandwidth is not unlimited, and any excessive use that has a negative impact on other users (for example, prolonged streaming, large downloads or server hosting) is prohibited.
  • The network is intended for personal use only. It must not be used for commercial purposes, for the resale of bandwidth or for the operation of a business.
  • Streaming, online gaming, video calls and downloads are permitted within reasonable limits that do not disrupt the overall performance of the network.
  • The building management or network administrator reserves the right to limit data speeds, block certain applications or implement traffic management measures if usage patterns adversely affect the service for others.

 

8.1.2. Prohibited Activities

Customers must not engage in any activity that is illegal, harmful or disruptive to the network. Prohibited actions include, but are not limited to:

8.1.2.1. Malicious and illegal use

  • Hacking, unauthorised access or penetration testing on any system or network.
  • The distribution of malware, viruses or phishing attempts.
  • Participation in cybercriminal activities, such as fraud, identity theft or unauthorised data collection.
  • Any use that breaches local, national or international laws, including copyright infringement, piracy or illegal downloading.

8.1.2.2. Network abuse

  • Using the network to send spam, unsolicited communications or bulk messages.
  • Exploitation of servers, torrents or bandwidth-intensive applications that adversely affect network performance.
  • Attempting to circumvent security measures or gain unauthorised access to other devices.

8.1.2.3. Inappropriate or offensive content

  • Hosting, sharing or distributing offensive, defamatory, obscene or illegal content.
  • Engaging in activities that encourage violence, discrimination or hate speech.

 

8.1.3. Monitoring and enforcement

  • The management of the establishment or the network administrator reserves the right to monitor traffic flows to ensure compliance with this policy.
  • If a Customer is found to have breached this policy, the measures taken may include: a warning or temporary suspension of access; permanent disconnection from the network; legal action, including reporting the matter to the authorities in the event of criminal activity.
  • Network security is not guaranteed, and users are responsible for their own cybersecurity measures, such as the use of firewalls, VPNs and strong passwords.

 

8.1.4. Limitation of liability

  • The Wi-Fi service is provided ‘as is’ and ‘as available’, without any guarantee as to the availability, speed or uninterrupted nature of the service.
  • The building management is not liable for any loss of data, hacking incidents or security breaches occurring on the network.
  • Guests assume all risks associated with connecting their personal devices to the network.
  • 8.1.5   Changes to the terms and conditions: these terms and conditions may be updated from time to time to reflect changes to policies, security measures or legal requirements. Continued use of the Wi-Fi network constitutes acceptance of the latest applicable terms and conditions. If you have any questions or wish to report misuse of the network, please contact City Pop.
  • 8.2   Customers must comply with all applicable laws and regulations when using the shared internet connection, in accordance with City Pop’s Acceptable Use Policy for the internet connection.

8.2.1. The following activities are strictly prohibited:

  • Unauthorised access to or use of data, systems or networks, including any attempt to probe, analyse or test the vulnerability of a system or network, or to circumvent security or authentication measures without express authorisation.
  • Sharing the internet connection with persons who are not part of the group of authorised users.

8.2.2. To ensure fair access to the shared internet connection, the following policy is in force:

  • Each user is allocated a specific bandwidth allowance of up to 100 Mbps per device.
  • Activities that consume excessive bandwidth, such as downloading large files and peer-to-peer file sharing, must be restricted to off-peak hours in order to avoid congestion and ensure fair use for all users.
  • The provider reserves the right to monitor data usage and take the necessary measures to prevent any misuse of the shared internet connection, including bandwidth throttling and termination of access for users who repeatedly engage in prohibited activities.

8.2.3. Maintenance Policy

To ensure optimal performance and reliability of the shared internet connection, City Pop will apply the following maintenance policy; consequently, three types of maintenance windows may take place during your stay.

  • Scheduled maintenance: Regular maintenance will be carried out during off-peak hours to minimise disruption. You will be notified at least 48 hours in advance of any scheduled maintenance that may affect service availability.
  • Emergency maintenance: In the event of unforeseen problems or urgent security threats, City Pop may carry out emergency maintenance without prior notice. Users will be informed as soon as possible of the nature of the emergency and the expected duration of the maintenance.
  • Service interruptions: During maintenance periods, users may experience temporary interruptions or reduced performance. City Pop will make every effort to complete maintenance tasks as quickly as possible and to restore the full service without delay.
  • 8.3   User support: If users encounter connectivity issues or require assistance during maintenance periods, they should contact City Pop.
  • 8.4   The provider will provide timely updates and support to address any concerns or issues arising from maintenance activities.
  • 8.5   Infrastructure upgrades: The provider may, from time to time, upgrade the network infrastructure to improve the quality and performance of the service. Users will be notified in advance of major upgrades and any potential impact on their internet connection.
  • 8.6   By accepting these terms and conditions, users acknowledge and agree that occasional maintenance operations are necessary for the upkeep and improvement of the shared internet connection, and undertake to comply with the policies described above.

 

  1. Booking Terms
  • 9.1   Customers wishing to stay at a City Pop 2NIGHT property can check accommodation availability and complete the booking process directly via the official City Pop 2NIGHT website (citypop.com) or via third-party booking platforms.
  • 9.2   Regardless of the channel used to make the booking, the Guest remains fully subject to these City Pop 2NIGHT Terms and Conditions.
  • 9.3   Regardless of the channel used, Customers must provide the necessary information and supporting documents to finalise the booking.
  • 9.4   The option to book additional paid-for facilities depends on the location of the relevant City Pop 2NIGHT property. Customers will be informed and may book any available additional facilities for an extra charge during the booking process or subsequently via the Customer App (available only after the check-in procedure has been completed).
  • 9.5   Once the booking request has been made, the Lead Guest must complete the mandatory identification procedure in full at check-in. If the Guest fails to complete this procedure, this constitutes a serious and substantial breach of the conditions precedent to the conclusion of a contract, and the booking process may be terminated with immediate effect without any compensation.
  • 9.6   If the identification procedure is not completed for all Guests, no access to the Pop will be granted to the Guest(s).
  • 9.7   The request will be refused if the Lead Guest is under 18 years of age or if the accompanying minors are not members of their family. Any exemption requires the consent of the minor’s legal guardian(s).
  • 9.8   The application will be refused if the Customer(s) are in possession of invalid or expired official documents (identity card, passport, visa, etc.).
  • 9.9   The application will be refused if the Customer(s) are in possession of compromised or forged official documents, i.e. where a document is publicly accessible or known to be compromised, or where it has been reported as having been used in a suspicious manner.
  • 9.10   The application will be reviewed if certain criteria do not fully meet the internal identity verification procedure.
  • 9.11   Payment must be made in accordance with the terms and payment method specified during the booking process. Cash payments are not accepted. Receipt of payment is a prerequisite for the legal validity of the booking. Regardless of any confirmation, City Pop 2NIGHT is not bound by the booking if payment is not received by City Pop 2NIGHT as agreed. The Customer remains fully liable once the booking confirmation has been issued.
  • 9.12   Cancellation and amendment terms depend on the rate and are displayed throughout the booking process as well as on the confirmation. Non-refundable rates cannot be cancelled, amended or refunded. Flexible rates may be cancelled or amended free of charge up to the deadline specified at the time of booking; after this deadline, the charges specified for the selected rate apply. A no-show is treated as a late cancellation in accordance with the terms of the booked fare. Refunds (where applicable) are processed via the original payment method; processing times depend on the payment provider.
  • 9.13   Bookings made via online travel agencies are subject to the definitions of no-show and the financial rules set by the relevant platform. City Pop 2NIGHT applies the same no-show charges as those specified in the rate of the agency selected by the Customer.
  • 9.14   Corporate and relocation bookings may be subject to negotiated terms and conditions regarding cancellation, invoicing, check-in formalities and communication procedures. These agreed terms and conditions shall take precedence over the standard Terms and Conditions only if this is expressly stipulated in the corporate contract drawn up for this purpose.
  • 9.15   The access code to enter the Pop will only be provided once the check-in procedure has been completed. Any additional legal charges or taxes, or any extra services ordered, will be itemised separately at the time of booking.
  • 9.16   The information provided by the Customer(s) at the time of the enquiry will be processed and stored in accordance with legal provisions and will be managed in accordance with City Pop’s Privacy Policy (citypop.com/privacy-policy), in accordance with the regulations in force at the relevant site. Any notifications to the authorities, etc., are made in accordance with legal provisions.
  • 9.17   The information contained in the booking request will be used by City Pop to fulfil its reporting obligations to the police, local authorities and other relevant bodies (e.g. tourist tax). These reports do not replace any additional registration obligations with local authorities, which are the responsibility of the Customer (where applicable).
  • 9.18   The Customer is hereby informed and acknowledges that the photographs of the Pop on the website and on third-party booking platforms refer to an actual Pop at the site, but that these photographs may not correspond exactly to the Pop booked. Not only the layout, but also certain decorative elements or the arrangement of the furniture may differ in the Pop actually booked and allocated.
  • 9.19   City Pop reserves the right to allocate a different Pop to the Customer before or after check-in if the previously allocated Pop is damaged or inaccessible for other reasons. If the newly allocated accommodation is cheaper than the one previously allocated, City Pop will refund the Customer the difference in price. If the newly allocated Pop is more expensive than the one previously allocated, City Pop 2NIGHT will waive any additional costs.
  • 9.20   If, for any reason, the booked room is not available at the time of check-in, City Pop 2NIGHT will make every effort to find alternative accommodation of a comparable standard, at no extra cost to the Guest. If the Guest refuses the proposed alternative or if City Pop 2NIGHT is unable to provide an alternative, City Pop 2NIGHT will refund the unused nights.
  • 9.21   Depending on the City Pop 2NIGHT property in question, a tourist tax or other mandatory tourist charges may apply in accordance with current local regulations. Customers are required to pay these charges in advance (such as the tourist tax per night) during the booking process. City Pop collects these charges on behalf of the local authorities and subsequently transfers them accordingly. It is the responsibility of guests to consult publicly available online resources provided by the relevant authorities or public bodies, where they can find all necessary information regarding any exemptions and other relevant details relating to local tourism legislation. The same rules apply to all additional guests, from their notified and registered arrival date.
  • 9.22   City Pop reserves the right to refuse a booking, including after an automatic confirmation has been sent to the Customer. Any refusal will be made within a reasonable timeframe and will result in a full refund of any sums paid.
  • 9.23   Failure by the Customer to comply with mandatory disclosure obligations and failure to comply with any legally binding requirements constitute material breaches of the contract, entitling City Pop to terminate the contract with immediate effect.

 

  1. Check-in and check-out

10.1. Check-in

  • 10.1.1   The City Pop 2NIGHT accommodation operates without on-site staff. The Guest will receive a notification at the email address provided so that they can complete self-service check-in. The check-in deadline is stated in the listing available on the website or on the external platform. If the third-party platform does not display the check-in time, it is the Guest’s responsibility to check the check-in times on the official website (Citypop.com). Access to the booked Pop is available from 3 pm. Access is keyless. An entry code will be provided on the day of check-in, provided that online check-in has been successfully completed.
  • 10.1.2   During self-service check-in, it is mandatory to enter the details of each Guest, including personal data, in order to verify their identity, contact details and other information required by law. The scope of the disclosure and collection of the required data depends on the applicable local legal provisions. Data is collected in accordance with City Pop’s Privacy Policy (citypop.com/privacy-policy/).
  • 10.1.3   Once self-service registration has been successfully completed, City Pop 2NIGHT will provide the Guest with essential information about the venue (address, including the street name, the City Pop 2NIGHT establishment number, the city’s postcode and the Pop number assigned to the Guest). Completing the online pre-check-in is mandatory. This includes identity verification, the submission of personal data and the provision of a valid payment card. The access code is generated and sent automatically on the day of arrival, only after all the required steps have been successfully completed. Without prior pre-check-in, no access code can be issued and the Guest cannot enter the Pop.

 

10.2. Check-out

  • 10.2.1   The Guest must vacate the Pop on the last day of the agreed contract period. The check-out time is indicated in the app and on the website.
  • 10.2.2   For departure, the Customer will receive instructions on the procedure by email and, where applicable, by SMS or WhatsApp message. The Customer is required to inform City Pop 2NIGHT of any damage to or destruction of the furniture provided before their departure.
  • 10.2.3   Any damage to or destruction of equipment, exceeding normal wear and tear and/or resulting from improper use, will be charged to the Guest. The amount due is determined on the basis of the residual value of the damaged or destroyed items and corresponds to the cost of repairs, plus the claims handling costs incurred by City Pop 2NIGHT.
  • 10.2.4   The Customer(s) must vacate the Pop entirely and remove all their personal belongings.
  • 10.2.5   If the Customer(s) have rented a storage space or a parking space, they are required to clear this storage space and remove the vehicle. The costs of removing any items left in the Pop, in the storage space or in the parking space after the check-out time has expired will be charged to the main Customer.
  • 10.2.6   Once the Customer has vacated the Pop, City Pop will carry out an inspection of the Pop and check the equipment inventory.

 

10.3. Early check-in and late check-out

Early arrival and late departure are subject to availability and may incur charges. An unauthorised late check-out beyond the agreed time may result in: (i) a late check-out fee (50 EUR), and/or (ii) the charge for an additional night if the Pop cannot be made available to the next Customer, and (iii) reimbursement of justified operational costs (e.g. rescheduled cleaning). Access codes may be automatically deactivated at or after the check-out time.

 

  1. Booking price/payment and deposit amount
  • 11.1   Until the booking is confirmed, the price is not guaranteed and may be updated from time to time. Once the booking has been made, the price for that period will remain unchanged.
  • 11.2   The booking must be paid for in advance, in accordance with the selected payment policy and payment plan. Please note that, for certain instalment payment options, the total amount is not due immediately. The payment schedule chosen at the time of booking (in accordance with the applicable payment policy), together with the associated terms and conditions, shall apply.
  • 11.3   The total price and the applicable payment schedule are displayed during the booking process and in the booking confirmation. If the Customer would like further information about the payment schedule, they may contact City Pop 2NIGHT by email.
  • 11.4   Accommodation will not be made available if the full payment – including the deposit – has not been made in accordance with the booking terms and conditions.
  • 11.5   Additional services are subject to the rates in force at the relevant City Pop 2NIGHT establishment and must be paid for in advance at the time of booking.
  • 11.6   Credit card transactions between the Guest and City Pop 2NIGHT are processed by an external provider, to whom the Guest’s registered credit card details are provided.
  • 11.7   City Pop 2NIGHT may charge a sum (the ‘security deposit‘) to a valid payment card provided by the Main Guest, in the amount specified at the time of booking and/or during the online check-in process. This security deposit is intended to cover any costs arising from damage, excessive cleaning, breaches of the Terms and Conditions, outstanding amounts or additional services, or the loss of keys/access badges.
  • 11.8   Following the Guest’s departure, City Pop 2NIGHT will carry out an inspection of the Pop and its inventory. The security deposit will be released in full provided that no damage, missing items, excessive cleaning, breaches of the Terms and Conditions or outstanding charges are found. In the event of any such issue, City Pop 2NIGHT reserves the right to retain all or part of the security deposit to cover the corresponding costs. The release of any remaining amount will be processed following the inspection. The time taken for the funds to be released depends on the card issuer and is beyond City Pop 2NIGHT’s control.

 

  1. Termination and handover of the premises
  • 12.1   City Pop is entitled to terminate this contract (and to repossess the Pop) if the Customers fail to fulfil their obligations under this contract, including obligations relating to any additional services purchased, unless the Customer remedies the breach shortly after receiving notification of non-payment from City Pop 2NIGHT.
  • 12.2   In the event of termination of the contract or upon expiry of the booked and paid-for period, City Pop 2NIGHT is authorised to enter the accommodation in order to clear it, pack the Customer’s personal effects and transfer them to another location, draw up an inventory and a damage report, including waste disposal costs (labour and disposal costs) and depreciation, secure the 2NIGHT Pop, to block access to it and, once it has been restored to good condition, to make it available again for future bookings.
  • 12.3   City Pop 2NIGHT may, at its sole discretion, contact the relevant authorities if circumstances so require.
  • 12.4   The Customer is required to cover any additional costs incurred by City Pop 2NIGHT as a result of the unplanned evacuation. In particular, the Customer is required to pay for the period of non-occupancy for the remainder of the booking (the booking price for the contractually agreed period until the same Pop is booked by another Customer, etc.).
  • 12.5   All additional costs incurred as a result of the intervention of an official representative, the preparation of the inventory of fixtures, additional cleaning costs and the storage of the Customer’s personal effects (valuables only) or other items shall also be borne by the Customer and must be paid by them.
  • 12.6   The Customer’s valuable personal belongings listed in the inventory (items or documents deemed worthy of retention in accordance with local customs, as determined at City Pop 2NIGHT’s sole, prudent and reasonable discretion) will be retained by the establishment for one month. During this period, Guests may collect their belongings from the establishment. City Pop 2NIGHT is not responsible for the dispatch of personal belongings. The arrangement of collection is entirely the responsibility of the Guest.
  • 12.7   If the Customer does not collect the stored items after one month, City Pop 2NIGHT is entitled to dispose of or recycle them at its sole discretion.

 

  1. Customers’ Liability
  • 13.1   The Customer(s) are liable for any damage caused by negligent, inappropriate or non-contractual use of the Pop, its inventory, equipment or generally accessible facilities or equipment. This liability applies both to material damage (repair costs to rectify the fault) and to administrative costs incurred (organising and monitoring the repair of the fault), the latter being invoiced at cost price.
  • 13.2   The Guest(s) shall be liable for any damage caused to the building and its fixed installations, as well as for any damage to third parties’ property occurring within the building and caused by the Guest(s).
  • 13.3   City Pop 2NIGHT may, at its sole discretion and without being obliged to do so, offer to pay a lump sum (for example, the retail price, a goodwill gesture or an equivalent amount) in order to settle the dispute and expedite its resolution.
  • 13.4   Any unauthorised alterations of any kind made to the inventory, fixtures and fittings by the Clients within the Pop or in the communal areas are prohibited. The Guest must pay, within 5 days of the invoice date (due date), the costs incurred for the professional restoration of any unauthorised alterations, as well as, where applicable, for the replacement or restoration of the premises to their original condition.
  • 13.5   In the event of a false fire alarm triggered by a Guest’s behaviour, including, but not limited to, smoking or the misuse of fire safety equipment, a charge of EUR 500 will be invoiced (without prejudice to any other damages that may be claimed).

 

  1. City Pop’s Liability
  • 14.1   City Pop 2NIGHT shall not be held liable in the event of force majeure, nor for any damage resulting from the Guest’s fault, negligence, improper use of the accommodation or failure to comply with these Terms and Conditions.
  • 14.2   City Pop 2NIGHT cannot guarantee uninterrupted or risk-free access to the building at all times, particularly in the context of local weather conditions, which may be extreme (snow, black ice, hail, heavy rain, etc.). Guests are required to take appropriate precautions and use equipment suitable for such conditions.
  • 14.3   City Pop 2NIGHT covers its civil liability to the extent required by applicable local legislation.
  • 14.4   If, despite reasonable efforts, a booked service is exceptionally unavailable for an extended period, the Customer may be entitled to a discount, in accordance with City Pop 2NIGHT’s usual practices, for the period of non-use.
  • 14.5   City Pop 2NIGHT will ensure the proper selection, training and supervision of support staff in accordance with applicable legal requirements.
  • 14.6   To the extent permitted by applicable law, City Pop 2NIGHT shall not be held liable for any failure or delay in the performance of its obligations if caused by events beyond its reasonable control, including, but not limited to, force majeure, natural disasters, epidemics/pandemics, government restrictions, strikes, civil unrest, utility outages not caused by the party concerned, or the failure of public services. Where performance is affected by such an event, obligations shall be suspended for the duration of the event.
  • 14.7   Certain services — including, but not limited to, laundry, digital check-in, online booking platforms (agencies), identity verification providers and payment providers — are managed by third parties. City Pop 2NIGHT is not liable for any interruptions, errors or failures caused by these providers.
  • 14.8   The measures put in place to ensure the safety of people and property comply with local practices. There is no continuous surveillance of all areas accessible to the public.

 

Exclusion of warranty and limitation of liability relating to facilities and services

  • All equipment, facilities, furniture, materials and services provided by City Pop 2NIGHT, whether located inside the Pop or in the communal areas, are provided ‘subject to availability’ and ‘as is’. City Pop 2NIGHT endeavours to ensure their proper functioning and availability. However, City Pop 2NIGHT cannot guarantee uninterrupted availability, specific performance levels or the suitability of any equipment for a particular purpose. Such circumstances shall not affect the validity of the booking, provided that they do not deprive the Customer of the essential features of the accommodation service.
  • The temporary unavailability of facilities and services — including, in particular, Wi-Fi, communal areas, lifts, laundry services, heating or air-conditioning systems, lighting, kitchen facilities or any other building installations — may occur due to maintenance work, repairs, technical faults, security measures or operational constraints. Such temporary unavailability shall not give rise to any entitlement to compensation, a price reduction, termination of the contract or damages, unless otherwise required by law.
  • The Guest(s) use the equipment and facilities in the communal areas (including fitness equipment, kitchen equipment, laundry facilities and other shared equipment) at their own risk. It is their responsibility to ensure that they are physically fit to use this equipment safely and to comply with the instructions displayed, the house rules, the operating instructions and the applicable safety regulations.
  • City Pop 2NIGHT shall not be held liable for: misuse, incorrect handling or dangerous use of the equipment by the Guest(s) or third parties; breakdowns or faults caused by third-party service providers, disruptions to public services or factors beyond City Pop 2NIGHT’s control; any inaccuracies or discrepancies between the equipment shown (including photographs or examples) and the equipment actually available during the Customer’s stay.
  • Where a facility is operated or supplied by a third-party service provider, the Customer may also be subject to that provider’s terms and conditions. City Pop 2NIGHT accepts no liability for any interruptions, malfunctions or unavailability resulting from third-party services.

 

Completeness of booking terms and conditions/derogatory agreements

  • The rules applicable to the booking are exhaustively set out in the property description, the information provided at the time of the booking request, the booking confirmation, these General Terms and Conditions, and the applicable legal provisions. No other provisions apply. Furthermore, no verbal agreements exist or are permitted.
  • If the Customer wishes to benefit from special conditions and/or exceptions to these General Terms and Conditions, these must be the subject of a specific and express agreement by City Pop 2NIGHT.
  • Any supplementary agreement concluded on an individual basis with the Customer must be formalised at least in electronic form and be subject to express acceptance and confirmation by City Pop 2NIGHT. Any tacit acceptance is expressly excluded.
  • City Pop 2NIGHT is entitled to remind Customers, within the framework of the applicable rules, agreements and legal provisions, of their compliance obligations and to issue instructions to them to that effect (right to issue instructions / internal regulations / code of conduct, etc.).

 

Updates to the Terms and Conditions

The T&Cs applicable to a booking are those accepted by the Customer at the time of booking. City Pop reserves the right to amend the content of these T&Cs. Any new version will be available on the City Pop website and will apply from the date of publication to bookings made after that date. Customers will be notified of any amendments by email to the address used for the booking. It is the Customer’s responsibility to check their inbox regularly (including junk or spam folders) and to inform City Pop of any change of email address. If the Customer does not accept this amendment, the Terms and Conditions accepted at the time of booking will remain fully applicable to that booking.

 

Additional or missing provisions

If, during the period of the booking, a legally relevant matter has not been regulated or has not been sufficiently regulated, or if a provision proves, initially or subsequently, to be legally unenforceable, the gap shall be filled, as a matter of priority, by analogy with the existing provisions, taking into account their purpose and economic objective, as well as the economic balance between the Customers and City Pop 2NIGHT. The meaning and spirit of the original booking, as well as the associated provisions and agreements, must be preserved as far as possible. The guiding principle is to adopt an appropriate alternative solution which is of general application, yet also fair in light of the specific circumstances, and consistent with City Pop 2NIGHT’s business model.

 

Applicable law and dispute resolution

  • Customers acknowledge that bookings are confirmed and processed exclusively online. No signed paper document is required for the booking.
  • French law applies to all contracts entered into, unless otherwise provided for in these Terms and Conditions.
  • In the event of any difficulty or dispute relating to the performance of the contract, Customers undertake to contact CityPop 2NIGHT in order to seek an amicable solution. This preliminary step must be taken by sending a written complaint to CityPop 2NIGHT by registered post with acknowledgement of receipt to the following address: 16–18 rue Eugène Baudoin and 14 rue Gabriel d’Estrées, Vanves (92170), or by email to [email protected]. If the complaint is not resolved to the Customer’s satisfaction, or if CityPop 2NIGHT fails to respond within a reasonable period of two (2) months, Customers may seek recourse through conventional mediation in accordance with applicable legislation. CityPop 2NIGHT is affiliated with the following consumer ombudsman, to whom Customers may submit their dispute: Société de la Médiation Professionnelle (SMP), www.mediateur-consommation-smp.fr, 5 rue Salvaing – 12000 Rodez. Customers have one year from the date of their written complaint addressed to CityPop 2NIGHT to refer the matter to the mediator.
  • In the absence of an amicable settlement or a solution arising from mediation, the dispute may be brought before the courts with territorial jurisdiction in accordance with the applicable legislation.

 

Code of Conduct and Terms of Use

 

The CityPop 2NIGHT Code of Conduct ensures that all Guests can coexist harmoniously. It aims to enable all Guests to enjoy a pleasant and respectful stay. Every Guest is required to comply with it. The Main Guest is responsible for any inappropriate behaviour on the part of any Additional Guests accompanying them. By confirming the booking, the Guest confirms that they have read and understood the Code of Conduct. Any serious or repeated breach of the Code of Conduct by the Guest or any Additional Guests accompanying them entitles CityPop 2NIGHT to terminate the contract.

 

20.1. Proper use of the Pop, its facilities, furniture and equipment

  • 20.1.1   Guests are required to use the building, facilities and equipment with care and in accordance with their normal intended use. Any damage or destruction, as well as the costs of replacement, shall be borne by the Guest responsible. Guests must not carry out any repairs on their own initiative within the Pop, nor to the facilities, equipment or furniture. They are required to report any damage and any necessary repairs to City Pop 2NIGHT.
  • 20.1.2   Structural alterations and changes to the furniture are strictly prohibited. The furniture must not be altered or damaged. Customers may bring their own small, movable items of furniture, which must not be fixed or permanently installed within the Pop. Any small items of furniture brought in must not damage the existing equipment or the remaining furniture. The permanent installation of satellite dishes or other technical equipment, as well as the laying of additional cables, is prohibited.
  • 20.1.3   Tenants are not permitted to remove furniture, furnishings or equipment from the flat and/or to dispose of them. It is also prohibited to take equipment from the flat into the building’s communal areas or to use such equipment there.
  • 20.1.4   The use of any type of private auxiliary heating appliance is prohibited. To avoid excessive energy consumption, windows must not be kept open at all times or left ajar whilst the heating is in use.
  • 20.1.5   Before using any electrical appliances, you should check that they are compatible with the national voltage of 220 to 230 volts. The presence of an internationally recognised safety mark (for example, ‘CE’) may indicate compliance. If not, these appliances must not be used. It is a criminal offence to use electrical appliances that do not comply with current standards and/or are faulty. Guests are personally liable for any damage resulting from failure to comply with this essential rule and may face criminal prosecution.
  • 20.1.6   Guests are not permitted to make any alterations to sockets or other electrical installations. If a socket is not suitable, a commercially available plug adaptor must be used. Guests are fully liable for any damage resulting from failure to comply with these provisions.
  • 20.1.7   Sunshades must not be used in bad weather.
  • 20.1.8   For safety reasons and to prevent unpleasant odours, it is forbidden to store items, clothing, shoes, shelves, rubbish, sports equipment, etc. in communal areas, particularly in front of the Pop’s entrance door, in the corridors or on the balcony.
  • 20.1.9   It is strictly forbidden to dispose of solid waste, such as food scraps or hygiene products, in the toilets or any other drainage system. Any costs arising from damage to or malfunction of the toilets or drainage systems caused by failure to comply with this rule will be borne in full by the responsible guest.
  • 20.1.10   The use of lifts must comply with the rules displayed inside them and, under no circumstances, should they be used to carry heavy loads. The transport of bulky goods in lifts is prohibited. Lifts are intended for the transport of people, not objects. Guests are liable for any damage caused to lifts as a result of inappropriate or prohibited use. The emergency call button in the lifts must only be used in an emergency.
  • 20.1.11   When using the communal areas of the City Pop 2NIGHT building, guests must do so with care and leave the premises clean. Guests are required to leave the communal areas in good condition after use.

 

20.2. Obligation to respect other Guests

  • 20.2.1   From 10.00 pm to 7.00 am, the night-time quiet hours set by the authorities apply. During this period, any activity causing a nuisance, as well as unnecessary noise, must be avoided, both inside the building and in the surrounding area.
  • 20.2.2   Guests must refrain from any behaviour likely to disturb other Guests, in particular slamming doors or speaking excessively loudly in the communal areas or within the Pop. City Pop 2NIGHT reserves the right to intervene in the event of non-compliance with these rules.
  • 20.2.3   Sound-producing devices of any kind may only be used within the Pop at a reasonable volume compatible with domestic use. Their use is prohibited in communal areas, as is the organisation of private concerts, performances or, unless expressly booked for this purpose, private parties involving an exclusive group of people. Choirs or musical rehearsals, whether taking place in the Pop or in communal areas, are not permitted.
  • 20.2.4   In order to ensure peace and quiet for all, playing a musical instrument is prohibited. The use of amplification systems is also prohibited in the Pop and in communal areas. Singing loudly is treated in the same way as playing a musical instrument.
  • 20.2.5   Smoking, including vaping, is prohibited throughout the building. It is also prohibited to light open fires, candles, sparklers, incense sticks or any other similar source of ignition. The responsible guest will bear the full cost of any emergency services (fire brigade, police) called to the premises. City Pop 2NIGHT reserves the right to claim additional damages. Any breach of the smoking ban will result in a penalty of EUR 200. Should the fire alarm be triggered as a result of such behaviour, this penalty of EUR 200 will be added to the penalty of EUR 500 for a false fire alarm, making a total of EUR 700.
  • 20.2.6   Pets are not permitted. No exceptions will be made. Failure to comply with this ban, which in particular causes noise or odour nuisance to other guests and/or excessive wear and tear or damage to the Pop, constitutes a serious breach entitling City Pop 2NIGHT to terminate the contract immediately.

 

20.3. Waste management

  • 20.3.1   The disposal of waste and the proper management of bin bags are the responsibility of Guests.
  • 20.3.2   Depending on the location of City Pop 2NIGHT, only official, chargeable bin bags must be used: these can be purchased from the city’s main supermarkets or at authorised sales points. Only these official bags may be placed in City Pop 2NIGHT’s waste collection systems (where available). If no bins are provided by City Pop 2NIGHT or are available on site, waste must be disposed of at the collection facilities provided and managed by the relevant local authority. Any fly-tipping is liable to penalties imposed by the police.
  • 20.3.3   Public collection points, sometimes managed by the authorities and freely accessible, may be available for certain recyclable waste such as glass, metal, used oil, PET and other plastics, as well as clothing and footwear. For further information, please consult the websites of local authorities and behave in a responsible and environmentally friendly manner.
  • 20.3.4   The bins provided on the premises of City Pop 2NIGHT are intended solely for waste generated in the area where they are located and must not be used to dispose of personal waste accumulated in your Pop.
  • 20.3.5   It is strictly forbidden to leave bin bags or waste of any kind inside the building (including on the floors, in communal areas, etc.) outside the bins provided for this purpose, or to dispose of waste in an unauthorised manner outside the building (garden, entrance, etc.). Such behaviour may result in penalties imposed by the authorities (fines). Furthermore, any disposal of waste outside the designated areas or bins will result in a penalty of EUR 150.

 

20.4. Humidity

  • 20.4.1   Tenants must comply with the prevention measures, which must be carried out at least daily or whenever necessary. Adequate ventilation and a complete change of air within the Pop are essential to prevent the formation of mould, which is harmful to health.
  • 20.4.2   Moisture generated by the use of bathrooms or by cooking must be eliminated through intensive daily ventilation. Intensive ventilation means opening all windows fully (excluding the front door) for five to ten minutes, three times a day.
  • 20.4.3   Guests are liable for any mould that forms in their Pop should they fail to comply with the above-mentioned prevention rules or should they use the premises negligently. In such cases, they will be liable for the costs associated with the damage, as well as the costs of any necessary repairs or replacements.

 

20.5. Safety

  • 20.5.1   In the event of an emergency, Customers must first contact the public emergency services (police, fire brigade, medical services). For any operational assistance (lost access, code issues, maintenance), the contact details provided at check-in or the email address [email protected] should be used. The availability times for remote support and response times are indicated in the app and may vary depending on the location. City Pop 2NIGHT does not have staff on site at all times, and the building does not have specifically trained security staff who can be called upon in an emergency.
  • 20.5.2   In the event of criminal incidents (break-ins, threats, etc.), Guests must immediately contact the police via the local emergency number. City Pop 2NIGHT must then be informed via the communication channels or by email.
  • 20.5.3   All guests must familiarise themselves with the evacuation plan displayed on the wall upon arrival at the Pop.
  • 20.5.4   In the event of a fire or suspicious smoke suggesting a fire has broken out (for example, the smell of burnt electrical cables), the fire brigade must be contacted immediately via the emergency number and/or the fire alarm button must be pressed. City Pop must also be notified via the relevant communication channels or by email. Attempts to extinguish the fire should only be made if the incident is minor and poses no risk to people in the building. If there is any doubt, however slight, the fire brigade must be alerted.
  • 20.5.5   In the event of a medical emergency, first aid must be administered immediately and the local medical services must be contacted by telephone. City Pop 2NIGHT must also be notified via the communication channels or by email.
  • 20.5.6   The entrance door is locked throughout the day to prevent access by any unauthorised persons. Exceptions apply (for example, during opening hours for the delivery of post and parcels). Access to the building is only possible using a personal code and is not monitored by City Pop 2NIGHT staff.
  • 20.5.7   Existing surveillance systems do not allow, particularly for data protection and privacy reasons, for the monitoring of all areas or the permanent storage of recordings. Customers acknowledge and accept that the existing security measures are in place. For further information, please refer to City Pop 2NIGHT’s privacy policy on CCTV surveillance.
  • 20.5.8   A zero-tolerance policy applies in the following cases: trafficking in narcotics or illicit substances, arms trafficking, money laundering or counterfeiting, and commercial activities of a sexual nature. Should there be any evidence suggesting such activities, City Pop 2NIGHT will contact the police. Customers involved in such activities will be immediately ejected from the premises, without entitlement to a refund. City Pop 2NIGHT will draw up the final bill as if the Customer(s) concerned had left the premises early and of their own accord. The primary Customer who has been ejected will remain liable for any outstanding balance, as well as the applicable compensation, including costs incurred by the authorities.
  • 20.5.9   City Pop 2NIGHT reserves the right to monitor the security systems in the Pops in the event of damage affecting the building (inside or outside, damage caused to other Pops or similar situations).

 

20.6. Lost property

  • 20.6.1   Items found in the Pops or communal areas are recorded and kept for a maximum of 30 days, unless they are perishable or dangerous. To reclaim an item, Customers must contact City Pop by emailing [email protected], providing a description, details of their stay and a delivery address. Return and handling charges are payable by the Guest and must be prepaid. Items not claimed after the retention period are donated or disposed of responsibly. City Pop 2NIGHT accepts no liability for the loss or damage of found items, unless otherwise required by law.

 

20.7. Summary of charges and penalties

In order to ensure the safety, cleanliness and comfort of all occupants, as well as the proper maintenance of the property and its facilities, charges and penalties may apply in the event of a breach of these Terms and Conditions, damage or inappropriate behaviour. These measures are intended to protect the community and ensure compliance with the house rules and applicable regulations. Below is a summary of the main charges applicable under these Terms and Conditions.

  • Triggering an unjustified fire alarm due to the Guest’s behaviour (including smoking or misuse of equipment): €500, plus any emergency services call-out charges where applicable.
  • Breach of the smoking ban (including vaping): €200. If the breach triggers a false fire alarm, a total of €700 will be charged.
  • Disposal of waste outside designated areas or waste storage facilities: €150, to which any fines or penalties imposed by the authorities may be added.
  • Excessive cleaning beyond the standard level (e.g. heavily soiled Pop): charges based on a detailed quote, which may be deducted from the security deposit or charged to the registered card.
  • Damage caused to furniture, fittings, lifts or communal areas: repair or replacement costs will be charged, plus administrative fees, which may be deducted from the security deposit.
  • Unauthorised late check-out: late check-out fees and/or an additional night’s charge will be applied.
